QUESTION: during Family Mediation, will a Family Mediator give us legal advice?
ANSWER: no - even though your Family Mediator may be a lawyer by training, he/she/they are unable to give either you or the other party legal advice. The Mediator's role is to be a neutral facilitator of negotiations which will, hopefully, result in a settlement of the issues in dispute. When the right words flow, mountains can be moved. When they don’t, the potential for disaster is nigh. In my daily work with clients, I encounter examples of poor communication - in many instances, even subtle shifts can alter and improve an outcome. As a PC, I see this every day, and I work with parents to make their exchanges more effective, more focused, less about grievance and fault finding. I created the graphic below for educational purposes - it is based on some research and my own experience of what works and what does not. Hope you will find it useful.
