What is a 'Living Will'? ✍️

The term ‘Living Will’ is often used to refer to what’s known as an ‘advance directive’ in Scotland, or an ‘advance decision’ in England, Wales and Northern Ireland.

It is a written record of medical treatment that you may or may not wish to receive in the future. It will only come in to effect if you lose mental capacity or otherwise lose the ability to communicate your wishes.

What is a Larke v Nugus request? 🤔

Where there is a dispute about the validity of a will, one way to avoid unnecessary legal hurdles is for the will writer to prepare a statement about the circumstances in which the will was made.

A Larke v Nugus request is a letter that is sent to the professional who prepared the will to gather as much information as possible about how it was prepared and executed.
