The government is consulting on changes to the Human Medicines Regulations 2012 that would give community pharmacists greater flexibility when dispensing medicines.

Under the proposal, pharmacists could, in certain cases, supply a different strength or formulation of a prescribed medicine to help maintain patient access.

The aim is to improve access to medicines, reduce pressure on the healthcare system and support more person-centred care.

Pharmacists are invited to share their views on the potential benefits, risks and impacts before any legislative changes are implemented.

New regulatory changes take effect on 1st October 2025. Practice leaflets and staff reference requirements have been removed, and NHSmail is replaced

Health and Wellbeing Boards can update pharmaceutical needs statements, but must not provide new analyses or identify service gaps. The term “at or from” clarifies that activities can start at the pharmacy and be completed elsewhere. The HPV vaccine can now be supplied via centrally procured stock.

Community Pharmacy England (CPE) has updated guidance on the NHS Pharmacy Contraception Service (PCS): oral contraception (OC) can only be supplied for contraceptive purposes. PGDs, which provide the legal framework for supplies, cannot be used to treat acne or manage bleeding. Patients seeking OC for these reasons should be referred to their GP.

Pharmacists, following these guidelines is essential to ensure safe, professional, and compliant practice.

The guidance also highlights the provisional rollout of free oral emergency contraception (EC) from 29 October, offering an integrated sexual health service without GP registration. This will help increase access to contraception and support vulnerable communities.

NICE has recommended the use of tirzepatide as an option for managing overweight and obesity in adults. The guidance states that it can be offered alongside a reduced-calorie diet and increased physical activity, but only for those with a BMI of 35kg/m² or above and at least one weight-related health condition, such as type 2 diabetes or hypertension.

For pharmacy professionals, this guidance could reshape obesity management pathways across the NHS. Clinical trial evidence shows tirzepatide is more effective than lifestyle measures alone, with data also suggesting greater benefit compared with semaglutide. For those already on tirzepatide prior to this guidance, treatment may continue under existing NHS arrangements.

New hub and spoke dispensing Terms of Service have been laid before Parliament this week, complementing the Human Medicines Regulations 2012 hub and spoke changes announced earlier this year. The regulations apply when the hub pharmacy is owned by a different legal entity than the spoke.

Pharmacy professionals are advised to ensure the hub owner is a fit and proper person before entering arrangements and to notify their ICB at least 28 days prior to commencing hub and spoke dispensing. Core dispensing activities must be covered by written agreements detailing responsibilities, data sharing, exit clauses, and business continuity plans. Hubs cannot subcontract these functions further, and ICBs may raise objections if necessary.

These measures aim to safeguard patient safety, transparency and robust governance across NHS hub and spoke dispensing.

Three elements of the Community Pharmacy Contractual Framework (CPCF) in England are due to change in October, with dates provisional and subject to NHS confirmation.

The Pharmacy First service will have new clinical pathways and PGDs from 1 October, with IT systems updating overnight on 30 September to match the revised documentation.

From 29 October, the Pharmacy Contraception Service will expand to include drospirenone and oral emergency contraception. For the first time, pharmacy technicians can deliver the service under a supervising pharmacist SOP. The New Medicines Service (NMS) will include depression as an eligible therapeutic area, with updated service specifications and NMS Eligible Drug List. Sub-contracting is not permitted, and consultation timings have been clarified.
