關於 Thai Relax Limited 抄襲百藝源創有限公司旗下品牌 Tora Massage 百虎巡按 網頁內容之嚴正聲明
百藝源創有限公司（下稱 本公司）近日發現一間同行按摩店，Thai Relax Limited 旗下的 MeThai 自在。泰 按摩店涉嫌抄襲本公司旗下按摩店，Tora Massage 百虎巡按的宣傳內容超過30項，包括文章、排版及平面設計等。
該行為已嚴重侵犯本公司之版權，並構成刑事罪行，最高刑罰為監禁4年及就每份侵權物品被罰款港幣50,000元；此等侵權行為亦對行業的公平競爭原則，以及創作相關內容的同事極不尊重。
本公司在此作出以下嚴正聲明：
1. 本公司從未授權該公司及/或任何第三方使用或參考本公司之網頁內容、設計概念及其他相關創作。
2. 本公司所有設計及內容均為本公司團隊原創，屬於受法律保護之知識產權。本公司強烈譴責任何侵犯知識產權的行為，並要求相關公司立即移除所有侵權內容，停止侵權行為，並作出正式公開道歉。
3. 本公司在採取一切法律行動前，亦曾經和該公司溝通，表示該公司的價目表內容及設計與本公司非常相似，惟該公司未有移除相應內容，及後更將本公司的創作一字不漏地用於其官方網站。
4. 本公司已就此事件向香港海關舉報，並正積極配合調查。同時，本公司已展開民事法律程序（檔案編號：HCIP 2/2025），控告 Thai Relax Limited 及其負責人 朱佩珊，追究相關侵權行為，保障本公司合法權益。

Official Announcement Regarding Thai Relax Limited’s Plagiarism of Website Content Created by Tora Massage, a brand under Hundred Art and Creative Limited
Hundred Art and Creative Limited (hereinafter referred to as "the Company") has recently discovered that a massage shop, MeThai 自在。泰, operated by Thai Relax Limited, has allegedly plagiarized over 30 elements from the Company’s brand, Tora Massage 百虎巡按. These include promotion content, articles, layouts, and graphic designs.
This act constitutes a serious infringement of the Company’s copyright and is a criminal offence punishable by up to four years of imprisonment and a maximum fine of HK$50,000 per infringing item. Furthermore, such infringement blatantly disregards the principles of fair competition and disrespects the dedicated work of the Company's creative team.
The Company hereby issues the following formal statement:
1. The Company has never authorized the said company and/or any third party to use or reference its website content, design concepts, or any related creations.
2. All designs and content produced by the Company are original works created by the Company’s team and are protected under intellectual property laws. The Company strongly condemns any infringement of intellectual property rights and demands that the infringing company immediately remove all plagiarized content, cease all infringing activities, and issue a formal public apology.
3. Prior to initiating legal action, the Company had communicated with the infringing company, highlighting the striking similarities between their price list content and design and those of the Company. However, the infringing company failed to remove the corresponding content and continued its actions. Subsequently, they even engaged in verbatim plagiarism by copying the Company’s creations directly onto their official website.
4. The Company has reported this matter to the Hong Kong Customs and is actively cooperating with their investigation. Simultaneously, the Company has initiated civil legal proceedings (Case No. HCIP 2/2025) against Thai Relax Limited and its Director, CHU PUI SHAN SHANNON, to hold the infringing parties accountable and protect its legitimate rights.
The Company sincerely thanks its customers for their continued support and urges consumers to support businesses that operate with integrity and respect intellectual property rights. Intellectual property is a cornerstone of creativity and enterprise, and its protection is not only a legal obligation but also essential for upholding fair market competition and fostering the sustainable development of the industry.
