It’s commonly misunderstood that holding a Power of Attorney gives authority to manage someone’s affairs after they have passed away. However, a Power of Attorney only applies while a person is alive.

Once someone passes away, that authority ends, and from that point, the executor named in the will becomes responsible for managing and carrying out the estate. Sometimes this will be the same person who held Power of Attorney, but it's not always the case.

This is why having a clear, up to date will is important, as it ensures everyone understands who is responsible when it matters most.

When someone passes away, the executor named in their Will is responsible for managing their estate. This includes making funeral arrangements, and ensuring their wishes are followed.

If there is no Will, or it cannot be found, additional legal processes may be required before decisions can be made. In some cases, this can also lead to differing views among family members when clarity is most needed.

Having a Will in place can make a difficult time that little bit easier, as it clearly sets out who is responsible and helps guide important decisions when it matters most.
