The refusal of the Chief Secretary of Khyber Pakhtunkhwa to approve the long-pending promotion cases of Doctors and Teachers.lecturers .professors, despite their fulfillment of all legal and procedural requirements, is a blatant violation of service laws and fundamental rights.
As per the Khyber Pakhtunkhwa Civil Servants (Appointment, Promotion, and Transfer) Rules, 1989, promotion cases must be processed in accordance with Rule 8 & Rule 9, which mandate that eligible officers who have completed the required service tenure, qualifications, and performance evaluations be promoted without unnecessary delay. Furthermore, the Khyber Pakhtunkhwa Civil Servants Act, 1973, clearly stipulates that promotions shall be based on seniority-cum-fitness, ensuring that deserving officers are not deprived of their rights arbitrarily.
The KP Establishment Department’s guidelines on promotion procedures, which require that Annual Confidential Reports (ACRs/PER), No Inquiry/No Audit Para Certificates, and service records be duly considered, have been fulfilled in these cases, rejection of all case unlawful.
The Supreme Court of Pakistan and the Peshawar High Court have repeatedly ruled that delays in promotions without legal justification amount to discrimination and are unconstitutional under Article 25.
