Writ petition where in the appointment of Chairman of the Pakistan Institute of Prosthetic and Orthotic Sciences, Hayatabad, who is also brother of Judge of the High Court namely Justice Ijaz Sabi, dismissed by Honourable Bench of Peshawar High Court consisting of Justice Musarat Hilali & Justice Abdul Shakoor.

The petitioners Imad Khalil and 3 others challenged the appointment of Chairman Ayaz Khan on the ground that he is an orthopaedic surgeon and also Head of Department of Orthopaedic, Khyber Teaching Hospital and drawing salary from both the institutes. They further stated that under section 5 of Pakistan Institute of Prosthetic and Orthotic Sciences Act, 1999 only expert in orthotic and prosthetic sciences can be appointed on the post which is a mandatory requirement.

They submitted that the institute is teaching BS in the specialty of Orthotic and Prosthetic Sciences and also certain diplomas to the students and Chairman is illegally appointed from a totally different field.

Orthotic and prosthetic deals with the artificial limbs and an orthopaedic surgeon deals with broken bones of a patient and the chairman is a misfit on the post.

They further stated that the case got delayed for years due to the reason that the appointee Ayaz Sabi Chairman PIPOS , is the brother of a serving Judge of the High Court, who also influenced the court in getting favorable decision to save his illegal appointment. Because the Hon'ble bench of the High Court while dismissing the said writ petiton misinterpreted section 5 of the PIPOS Act only to provide legal shelter to the illegal appointment of the chairman in sheer disregard to all the norms of justice.
