What an incredible May it's been for ACHE of Alabama! We're grateful for the enthusiastic participation and engagement from all our members and guests.

This month, we successfully hosted two impactful events:
🔹 From Strain to Strength: Transforming Rural Health Through Collaboration - This session sparked vital conversations and shed light on innovative approaches to improve rural healthcare.
🔹 Revenue Resilience: Safeguarding cash flow during mergers, acquisitions, and EMR transitions - Attendees gained valuable insights and strategies for maintaining financial stability during critical organizational changes.

Say hello to Rachel Gilbert! Rachel is a Partner in the firm’s Health Care Practice Group, focusing on assisting hospital clients with regulatory compliance, transactions, financial strategies, and advocacy related to participation in federal and state reimbursement programs.
Rachel has assisted in the development, implementation, and operation of new Medicaid reimbursement programs in several states, including Uncompensated Care (UC) programs, Delivery System Reform Incentive Payment (DSRIP) programs, managed care rate increase programs, and Upper Payment Limit (UPL) programs. Rachel also has significant experience advising public, investor-owned, non-profit, children’s, and rural hospitals on regulatory compliance issues related to participation in Medicaid and Medicare reimbursement programs, as well as representing hospital clients in regulatory audits and appeals.
Rachel has performed due diligence related to the reimbursement and compliance impact of several complex transactions, including mergers, acquisitions, and joint ventures. Rachel’s transactional experience also includes drafting and negotiating purchase agreements, professional services agreements, leases, and management agreements.
Rachel enjoys working with her clients to compliantly develop and implement hospital financial strategies. Rachel is well-versed in preparing advocacy materials for clients, developing talking points for C-suite executives, drafting proposed laws and regulations, performing complex financial modeling to determine the impact of proposed or adopted reimbursement rules, and facilitating coalitions of industry stakeholders to advocate to state and federal lawmakers for improved access to reimbursement

Cat Kirkland is a Partner in the firm’s Health Care practice group and represents a diverse set of healthcare clients, including hospitals, physicians, and healthcare start-ups, in legal, compliance, regulatory, and reimbursement-related matters.
Cat’s reimbursement work includes assisting hospitals with navigating supplemental Medicaid programs, such as the Medicaid disproportionate share hospital (DSH), upper payment limit (UPL), or incentive-based reimbursement programs. Cat has experience in working closely with state leaders and industry associations to implement and design new programs, as well as to modify existing programs as needed to ensure continued compliance. Cat’s reimbursement expertise also extends beyond Medicaid. For example, Cat has recently assisted both large and rural hospitals with reporting and auditing for the CARES Act Provider Relief Fund and has also helped other providers analyze billing practices and address overpayment determinations.
Cat’s practice is grounded in a strong knowledge of transactions, regulations, and compliance. Cat regularly assists with issues such as healthcare contracting and business matters, Stark, Anti-Kickback, and False Claims Act analysis, policy drafting, federal investigations, provider self-reporting to the Office of Inspector General (OIG), financial modeling, and compliance planning. Join us at Burr Auditorium with Rachel Gilbert, Cat Kirkland, and Oceans Healthcare CEO Stuart Archer to discuss concepts related to hospital participation in the Medicaid Program, with a specific focus on reimbursement and lessons learned in other states. Topics will include: base Medicaid reimbursement and the need for supplemental payments; Alabama’s current supplemental Medicaid payment programs; financing Medicaid supplemental payments; risks and benefits of potentially transitioning to managed care; and use of Medicaid waivers in other states to draw down additional Medicaid payments to providers!
