This is an important story that highlights 2 impending dangers to science:

1) Shadow docket SCOTUS ruling that will likely re-terminate grants due to being “DEI” (they aren’t tho).
2) Plan to re-terminate grants come Oct. 1 (FY 26)

This is important and time sensitive.

SCOTUS will soon be deciding on the shadow docket whether NIH grants will be re-terminated. If they stay Judge Young’s ruling, NIH will be further hindered from funding important science.

Stop the Stay.

The Supreme Court is poised to allow Trump to illegally terminate NIH grants. Let's speak out. There is not much time.

The Trump administration has been terminating grants across the federal government, including at NIH, disrupting research, often with flawed reasoning.

In June, a federal judge declared that some of these terminations are illegal and discriminatory. Part of the basis for the decision is that the reason provided by the administration for terminating the grants was that the award "no longer effectuates the program goals or agency priorities." However, this reason alone is not legally good enough, unless it is included as an explicit provision in the grant award itself.

However, with the new fiscal year beginning Oct. 1, the rules can be changed to lower the legal risk. What this means is that all of the grants that have been terminated and reinstated may be terminated again come Oct. 1, and this time it may be harder to fight.
