Advocating for Cameras in All Long Term Care Facilities in All States In 2011 I placed a hidden camera in my mother's nursing home room and caught eight aides abusing her. One aide was charged with 14 counts of felony abuse and plea bargained down to seven felony counts and went to prison for 10 1/2 years. Three were fired and three were disciplined. The nursing home was fined $357,000. All the major media around the world reported on the abuse, and it was included in many stories done on nursing home abuse including a CBS story that rated all 50 states on nursing home abuse, my mother was the one from Ohio. The media kept me in the news for 10 years after the abuse and that resulted in me finally getting legislation for Camera's in nursing homes. The Ohio Law named Esther's Law Ohio Senate Bill 58 unanimously passed in the Senate and Unanimously passed the House committee and is expected to become a law in Ohio soon.

This is the law Seven Democrat Senators Submitted, and one of them is Senator Murphy of Connecticut. I told all of them if you can support this law for staffing, you can submit a law for Cameras in All Long Term Care Facilities.

Both of these laws are for all 50 states and all long term care facilities. But they don't want to be a leader, only a follow. That is not the kind of politicians we need. They all must be leaders.

This is one of the biggest problem with our great legislators in Washington. They only want to represent the people in their district and not the people of the United States of America. You vote on issues for the entire country, but don't want to hear about the problems the entire USA is having. Refusing to listen to a problem of all the people is what you were elected for. I sure hope you don't become President one day.

You must stop court appointed guardianship before it happens. First start with a will even if you don't have assets you might win a lawsuit, When you pass away without a will it must go through probate court. With a will the court must follow it.

Make out a durable power of attorney in the event you become incapacitated for medical and financial. Go talk to an attorney and they will get this done.

Once a court appoints a guardian, the guardian must report to the court who becomes the Superior Guardian and your loved one becomes a ward of the state. Once the guardian is appointed the only one that could take it away is the court who appointed the guardian or a higher court, no one else can overrule a judge.

I was a POA for about five years, then I became a court appointed guardian. After death because there was no will and there was lawsuit money, I had to file to become an executor and you must be bonded. It took one year after death to settle the estate.

There is a lot more that happens in that year period where creditors and Medicaid can make recoveries. You must have a probe attorney, the court will not allow you to represent the case if you are not a probate attorney.

A will and a durable power of attorney will stop all of this. IF you wait till some appointed guardian takes everything you waited to long.

When we got the camera law passed in Nevada we were not aware of the new Guardianship law that was passed in Nevada. It is one of the first to pass this law. The new guardianship law in Nevada required a legal guardian to get approval from probate court to do just about anything. I said why would they have to go to court to get a camera installed from the judge or magistrate, that is why they are a guardian. But it was true. IN Nevada if you are a court appointed legal guardian you must get approval from the court to install the camera.

I believe a lot of advocates don't know about this law from what I see being posted.

We are watching a war all caught with cameras on live TV, and our Legislators are worried about passing a law that would allow only family to watch one person who can't tell us what is happening, to stop the neglect and abuse they suffer everyday in every long term care facility.

Ohio Senate Bill 154 is sitting in the Senate Health Committee and the Chairman refuses to hold hearings. This is an Amendment Bill to Esther’s Law that would add other facilities and more language.
Email shuffman@ohiosenate.gov and tell him to schedule hearings so we can get this bill passed.
