I made this six years ago. We just started drafting Esther's Law and haven't introduced it to the public yet. In 2018 my mother passed away and I had media stories talking about the camera law for Ohio and I wanted it for all states.

This is the appeal from one of the aides that abused my mother, she was sentenced to 10 1/2 years in prison. This is why it is so hard to get police, attorneys and courts to act on nursing home abuse. The aide appeals all the way to the State Supreme Court which refused to hear it. The appeals court upheld the lower courts decision. There is so much that goes into this I suggest you read this appeals court decision. One Judge dissented not on the lower courts decision, but on the law. You can read it at the end.

I'm in this story about several nursing homes facing wrongful death lawsuits. No matter how many stories are in the news about long term care abuse of our most vulnerable loved ones, legislators still refuse to do anything about it.
I'm at the end of this report talking about Esther's Law. Currently there is a Bill in the Ohio Senate that has been sitting in a committee were the Chair of the committee is refusing to hear the Bill. It will add assisted living facilities and add language to Esther's Law.
Many other states where legislators are also refusing to enact legislation like Esther's Law that would allow residents to have a camera in their room.

I see so many people on Facebook that are going to solve nursing home abuse and none of them signed the petition for a federal law for cameras in all long term care facilities.

Nursing homes are intended to be places of comfort and healing. But after three people died in Northwest Ohio, concerns are growing regarding staffing and safety in these facilities.

What is it that these legislators don't understand. In Ohio the Bill to add assisted living facilities and language is dying in committee, they will not hear it. IN Florida, Iowa, Michigan, Pennsylvania, Arizona, Wisconsin, North and South Carolina, Colorado, California, New York, and I worked with advocates in all the other states that don't have this law. They all Failed the camera law. They would rather see this happening then stop it. Every time a hidden camera is used it catches abuse. Hidden camera are legal, but there is no law that stops facilities from removing them if found.

This is filled with false information. They cite privacy, wiretapping, HIPAA, making a reality TV show, this is all not true facts. First of all Camera laws such as Esther's Law that is cited in this law firms page is a law. These camera laws are the notice to all one, two and all party consent states that electronic and or audio monitoring is allowed in residents rooms. There are about 20 states that have some kind of camera law and none of them in 20 years that this law has been in effect, has violated any wiretapping laws. They also post a sign, and ignorance of the law is not acceptable in a court of law.

If this law firm was right, there would be no camera laws. The same also applies to HIPAA. There has been no cases of HIPAA violation in 20 years because of camera laws. Lastly why does this law firm think that this camera law could be used as a reality TV show. There is only one person responsible for viewing the video, even the facility can't view the video without the consent of the resident. It cannot be streamed or posted.

As for "Privacy", it has been established not only with the camera law being 20 years old, but a Georgia State Supreme Court ruled that the only one that has privacy rights is the resident. No one has the expectancy of privacy in a residents room.

Nursing Home News - Long Term Care News

This is the third or fourth story that aired about my mother's abuse. This is 14 years ago. I never stopped advocating to stop the abuse in long term care facilities.

This is not about what politicians you contact, it's about contacting all politicians. It's not about making this a one sided issue, it's about making this an issue for all. This law has passed in Red and Blue states, so make this a Red, White and Blue issue.

The politicians that refuse to do anything about this issue are the ones to vote out of office, even if its all of them.

This petition if for a federal law but can be used for a state law. It's usually only a handful of people that get laws passed, and that's probally what is going to happen with this.

This is another media report that I am in from last year, I'm at the end of this report. This was all caught on video using Esther's Law. You can see that Senator Kent Smith is in this video saying how they need to fix nursing homes, and he never does. He is still in office and I been emailing this for three years to amend Esther's Law with no response. But he makes it look like he is the savor of our loved ones in long term care facilities, he's not.

This video shows you how this nursing homes who was one of the worst in Ohio with many cases of abuse and dozens of complaints and none of them were listed on the Department of Health's site. The media confronts the DOH about this, see what they say. This nursing home had to change their name because of all the negative media stories about them. A lot of families from this facility called me.

This shows you just how much The Department of Health, Department of Aging, Legislators and nursing homes get away with, and they still do. This is going to get much worse in the next year,

The one thing I did was I never stopped. No matter what happened, no matter what anyone said, I never stopped. People that know me for the last 14 years know I never stopped. All 132 Ohio Legislators and the Governor of Ohio know I never stopped. The Media for the last 14 years know I never stopped. So when people tell me "that's not going to do anything" I tell them I will never stop.

The ones that don't try are the ones that stopped. What did I accomplish in 14 years. I got camera laws passed in two states. I have media stories from four states on getting their law passed. I have worked with legislators in another 10 states to get their camera law passed. I have advocates from all states contact me. I have advocates from several different countries contact me. Esther's Law has been an influence to cameras laws around the world, and in every state. Advocacy groups like AARP, State Ombudsman, McKnights, have called me.

A U.S. Senator called me and said this law should be on a state level and not a federal level. I told him what is happening on the State level with this law. It doesn't matter who the President is or what party is in control. They know this issue is not about being a Democrat or Republican. How many of you have I told it's your approach on this issue to get their attention. I tell the same thing to legislators. Whoever you can contact send them an email, including the President of the United States.
