Colorado has made Black history education mandatory for K-12 public schools. A new law, HB25-1149, requires the state to develop and implement standardized Black history education standards. The goal is to ensure all students learn about the history, culture, and contributions of Black Americans.

During the 2021-2022 school year, the Fountain-Fort Carson School District (located in Colorado Springs) received a significantly higher percentage of its funding from federal sources compared to most other districts in Colorado. In that school year, approximately 37.4% of the district's funding came from federal sources.

This higher federal funding percentage is often due to the district serving a large number of students who qualify for federal programs, such as those for low-income families (e.g., Title I funding), special education, and other specific needs-based grants. Districts with a higher proportion of economically disadvantaged students tend to receive more federal support to help meet those students' needs.

What role does the department play in IEPs/504 plans?

The department doesn’t play a direct role in the individual plans that provide special education services and school supports to eligible students. But it does provide money to help districts support students through IDEA, the special education law. In that way, it does influence how IEPs end up being used.

But even with an executive order, the president can’t end the following without talking to Congress, because they’re part of the law:

504 plans are based on a civil rights law, the Rehabilitation Act of 1973. They arose as a practice to document what schools were doing in terms of discrimination. The U.S. Department of Education oversees and enforces this anti-discrimination law in schools that get federal funding.
