The California Department of Public Health is issuing this Health Advisory to notify health care providers, laboratories and public health departments that a woman in Sacramento developed severe lead poisoning and died in March 2024 after using a hemorrhoid ointment from Vietnam called, Cao Bôi Trĩ Cây Thầu Dầu. The woman purchased the product on Facebook and a relative in Vietnam shipped it to the U.S. Testing of the product found that it contained 4% lead (39,000 ppm), a highly dangerous amount of lead. If healthcare providers have patients that have used this hemorrhoid ointment, urge them to stop using it and order a venous blood lead level (BLL) test immediately. Contact California Poison Control at 1-800-222-1222 for clinical guidance on lead poisoning. A quick primer on the Hearing:
In May of 2019, The DEP granted Enbridge the Chapter 91 Waterways permit. This caused Coastal Zone Management to issue the final permit necessary for construction to begin.
In May of 2022, Superior Court Justice Leighton vacated that permit and remanded it back to the DEP.

In July of 2022, DEP Adjudicator Jane Rothchild concluded that, in fact, the DEP had erred in granting this important permit.
DEP Commissioner Suuberg asked for 45 days to review Rothchild's decision--the first time that Suuberg did this throughout our long history of hearings, including air quality and wet lands. Each time that Rothchild ruled against us, Suuberg signed off on her decision with seven days, never questioning her judgement.

In August of 2022, Suuberg said he "needed more information," and remanded the decision back to the DEP.
Subsequently, our new adjudicator Salvatore Giorlandino gave the permit back to Enbridge, ignoring both Justice Leighton and Jane Rothchild.

In October of 2023, adjudicator Giorlandino heard arguments from the FRRACS, Enbridge, and the DEP.

Volume / Profit driven Healthcare has negatively impacted patients everywhere. We must have legislation in place to protect patients. Educating patients on the political issues that will move the needle back to patient protection, and away from protecting the profits of Insurance companies is key.

CMS has yet to update the prior authorization rule. Once CMS does this, the for profit insurance companies will need to follow suit.

The Washington Post (1/9, Sausser) reports that CMS “is weighing a proposed rule that could help millions” of Medicare Advantage patients by requiring “some insurers to automate their prior authorization processes, respond to expedited prior authorization requests within 72 hours and standard requests within seven calendar days, and provide more information when they issue denials.” However, the agency “closed the public comment period on the rule 10 months ago and has said nothing since then about when, or if, it will be finalized.” AMA President Jesse M. Ehrenfeld, MD, MPH, told KFF Health News on Monday that he hopes the proposed rule would “move the needle a little bit” – but cautioned that it may not be enough. “I think we’re going to have to have regulatory relief from Congress,” said Dr. Ehrenfeld.

COVID 19 vaccine recommendation

2023-2024 COVID-19 mRNA Vaccines


On Monday, September 11, the US Food and Drug Administration (FDA) granted emergency use authorization to the 2023-24 COVID-19 mRNA vaccines.

These updated mRNA vaccines contain a monovalent (single strain) Omicron XBB.1.5 component. All previous formulations of COVID-19 mRNA vaccines are no longer authorized for use.

On Tuesday, September 12, the Centers for Disease Control and Prevention (CDC) Advisory Committee on Immunization Practices (ACIP) recommended vaccination with the 2023-24 COVID-19 vaccine for all persons 6 months of age or older, followed by approval by the CDC Director. The updated mRNA vaccines will begin to ship from manufactures in the next few days and should be available to order (may include single-dose vials and prefilled syringes).

Key points to remember:
· The 2023-24 (monovalent, XBB.1.5) COVID-19 vaccines are the only FDA authorized/approved mRNA vaccines (Pfizer-BioNTech and Moderna) for vaccination against COVID-19 for individuals 6 months of age and older.
What actions to take now:
Updated mRNA COVID-19 vaccine recommendations will be available soon at https://www.cdc.gov/vaccines/covid-19/clinical-considerations/covid-19-vaccines-us.html:
· Everyone aged 5 years and older is recommended to receive 1 dose of 2023-2024 mRNA COVID-19 vaccine.

· Children aged 6 months-4 years should complete a multi-dose series (2 doses of Moderna or 3 doses of Pfizer-BioNTech mRNA COVID-19 vaccine) with at least 1 dose of the 2023-2024 COVID-19 vaccine.

· People who are moderately to severely immunocompromised should complete a 3-dose initial series with at least 1 dose of the 2023-2024 COVID-19 vaccine and receive 1 or more additional 2023-2024 COVID-19 vaccine doses.

Please note that a 2023-24 XBB version of the Novavax protein-based COVID-19 vaccine is currently under review for emergency use authorization by the FDA for individuals aged 12 and older.
