We wanted to provide some updates that are now in effect as of Jan 1, 2026. Under federal law, healthcare providers who receive an overpayment from Medicare or Medicaid must report and return that overpayment within 60 days of identifying it — or risk liability under the Federal False Claims.
Additionally, effective January 1, 2026,Florida law now requires licensed healthcare providers and facilities to refund patients for any overpayment within 30 days of determining the overpayment occurred. Failure to refund on time may result in fines and disciplinary action by the Agency for Health Care Administration (AHCA) or professional licensing boards.
What this means:
Overpayments must be identified promptly
Medicare/Medicaid overpayments must be returned within 60 days of identification
Florida patient refund law mandates refunds to patients within 30 days
Non-compliance can lead to financial penalties or professional sanctions
