HEAD AND BRAIN INJURY: YOUR RIGHTS AND YOUR FUTURE (Part 1 of 3)

If you’ve been in an accident and are now experiencing sensitivity to light, headaches, or nausea, you may have suffered a traumatic brain injury (TBI). Maybe you hit your head on something or were knocked unconscious and now something doesn't feel right.

The good news is head and brain injuries are finally getting the attention they deserve in light of the link discovered between football and brain injuries which has greatly increased the study of these life-changing injuries.

INJURY SYMPTOMS AND TIME

Unfortunately, a lot of accidents have brain injuries that are not immediately detected and will have a long-term impact on many aspects of your life. Some of these symptoms may take months to develop.

After an accident, some of the common symptoms of head and brain injury include:

Mental/Emotional Symptoms such as:

*Memory loss
*Confusion
*Difficulty concentrating
*Mood changes such as anger or newfound anxiety
*Trouble with sleep, either waking up or falling asleep

Physical Symptoms such as:

*Headaches
*Nausea
*Ringing in your ears
*Trouble focusing your eyes
*Trouble with speech
*Loss of smell or taste
*Trouble with coordination or loss of muscle function
*Weakness or paralysis

Brain injuries have far-reaching and varied consequences due to the nature of the brain being the main source of all bodily function and control.

Brain-injured people commonly experience issues with memory and confusion. There can be issues with either long or short-term memories depending on the location and severity of the injury.

WERE YOU UNCONSCIOUS?

The old method of judging the severity of your head brain injury was previously based on how long you were unconscious. This method over time has proven to be wholly inadequate. Some people with serious head injuries do not even experience unconsciousness. If you were unconscious, it’s important to get proper care as quickly as possible, but it’s equally important in cases where you may not have been unconscious but are now experiencing any of the above symptoms. In all cases, seek medical care & legal protection as soon as possible.

Small experiences in your life that impress you years later?

The TV show MASH aired in the late 70s and early 1980s. It was about a mobile army hospital unit in the Korean war.

In one memorable episode called "Morale Victory", a soldier who was a concert pianist damages his hand in a bomb incident and immediately becomes suicidal and hopeless.

One of the MASH Doctors takes it upon himself to convince the wounded soldier that he had much to live for and much more of himself to still share with the world.

Major Charles Wi******er III (David Ogden Stiers) a seemingly self-centered and arrogant surgeon from a rich family, who apparently had his own aspirations of becoming a pianist but lacked the talent, takes it upon himself to convince the pianist to live.

Wi******er somehow acquires a score of a piano composition designed for a one-handed pianist. He also pleads with the pianist that he can teach, write music, and use his good hand to handle the baton to conduct an orchestra. That his talent was not lost and is rare and valuable.

I had not realized the impact this episode had on me until so many years later when I damaged my own hand which led to my early leave from my health care practice.

Now, so many years later, as I seek to help write the stories of injury victims and help them to move past their injuries, I must give credit to MASH for the impression that show had on me roughly 40 years ago.

The point is you may never realize the impact of your experiences until it's needed elsewhere in your life. And for that, I remain very grateful.

Economic Impact of Injury

There are two numbers of highest importance to consider when calculating the loss of future earnings for an injured party:

1. Future total earnings potential based on the injured parties pre-injury career trajectory as reported by the US Bureau of Labor Statistics:

Current and future income based on profession

Bureau of Labor Statistics (BLS) reports on a wide spectrum of careers in each region and we now assume a life/work expectancy of 70 years of age for healthy individuals.

Current Age 26
Retirement 70
Potential years of work 44

Total Future Earnings are based on pre-injury career trajectory for low, median, and high average salaries and a modest 5% increase in wages every three years:

Example:
Low $3.43 million
Median average $4.76 million
High $5.7 million

2. The Anticipated Economic Loss based on the Injury Sustained

The National Bureau of Economic Research (NBER) in a paper dated March 2013, reported the following:

Ten years after onset, respondents with a chronic and severe disability have on average experienced a 79 percent drop in earnings, a 35 percent drop in after-tax income, and a 22 percent drop in food consumption. Two-thirds of this group never return to work.

If the NBER is applied to your client's future earnings, they stand to suffer a future lifetime loss of income that can be in the millions.

Low -$2.7 million ($3.43 million x .79)
Median average -$3.76 million ($4.76 million x .79)
High -$4.5 million ($5.7 million x .79)

This does not take into account the costs of lifetime medical care, based on the severity and anticipated long-term impairment and disability that may be present which may be estimated at $2-$10 million or more over the lifetime of your client.
