Two survivors—one a daughter caring for her Vietnam-era Army veteran father, the other the wife of a different Vietnam-era veteran—have filed a potential class-action lawsuit against the Department of Veterans Affairs. They argue that the VA improperly drops family caregiver appeal cases when the veteran dies, rather than allowing the appeal to proceed through the Board of Veterans Appeals. In both instances, the caregivers had applied to the VA's Program of Comprehensive Assistance for Family Caregivers (PCAFC) and filed appeals after denial—but when the veterans passed away during the process, their appeals were automatically dismissed. Advocates representing the survivors contend that this practice is unfair and should be revised so that caregivers can pursue benefits for the period during which they provided care. The VA’s program offers training, counseling, healthcare, and a monthly stipend ranging from $1,800 to $2,800 for caregivers of severely ill or injured veterans—approximately 15,000 veterans are currently enrolled in the program.
