Mission Statement:
The U.S. Donor Conceived Council strives to increase awareness of the needs, interests, and challenges of donor conceived people and advance change that promotes and protects their health, welfare, and human rights. Non-Discrimination Statement:
U.S. Donor Conceived Council (DCC) does not tolerate homophobia or transphobia. DCC acknowledges and respects diverse family structures. Thus, in advancing the rights of donor conceived people, DCC advocates for inclusive policies and opposes policies that stigmatize same-sex couples, single parents, and blended families. DCC’s vision statement and proposed policies do not, and are not intended to, single out or promote any particular family structure. Join PSAF and volunteers this weekend for a virtual phonebank to spread the word about Senate Bill 323 and the upcoming hearing. Together, we can stop S. 323 and defend access to reproductive healthcare.

What is S. 323?
S. 323, the so-called “Unborn Protection Act,” would redefine embryos in South Carolina law as “human beings.” This change would jeopardize access to IVF, restrict families’ choices about embryo use and disposition, and ignore the needs of people born through assisted reproduction.

Beyond IVF, S. 323 would also impose sweeping restrictions on abortion, miscarriage care, contraception, and essential pregnancy health services—putting the health and autonomy of countless South Carolinians at risk.

IVF access is under threat in South Carolina

The South Carolina Senate has scheduled a hearing for Senate Bill 323, the "Unborn Protection Act."

What is S. 323?

This legislation would define a human embryo in the South Carolina Health Code as “a human being that begins as a fertilized egg or zygote.”

How Does This Impact Donor Conceived People and Access to IVF?

This change would restrict access to in vitro fertilization (IVF) and other fertility treatments, and could prevent doctors from being able to practice IVF in accordance with clinical best practices. S. 323 does not recognize or protect the needs of people born through assisted reproduction. Instead, it seeks to prevent our existence.

The ability to make informed choices about embryo use and donation is essential to the dignity of donor-conceived people and their families. This bill could also restrict embryo disposition options, leading to forced embryo donation and ignoring the best interests of donor-conceived people, recipient parents, and donors alike.

Unlike most legislation, S.323 is moving outside the regular session, in a special process designed to fast-track the bill. Lawmakers need to hear from us: IVF must stay legal and available to families in South Carolina.

By now, you’ve likely seen the headlines about Kim Davis’s request for the Supreme Court to reconsider Obergefell v. Hodges. For many, these headlines are unsettling, and it’s natural to worry about what they mean for our families. For donor-conceived children with LGBTQ+ parents, marriage equality has been a cornerstone of security—safeguarding children’s well-being and helping to ensure their families are protected under the law.

It’s important to remember Davis’s petition is based on a narrow legal question the courts have already rejected. The Supreme Court receives thousands of requests like this each year and grants only a small fraction. There’s good reason for the Court to deny review in this case rather than unsettle something so positive for couples, children, families, and society at large.

Marriage equality remains strong, and families can take additional steps to protect themselves. The best way for LGBTQ+ parents to protect their family is to ensure that their parent-child relationship is secure in all states by obtaining a court judgment of parentage or adoption.

Parentage is the legal relationship between a parent and a child. When a child is born through donor conception, it’s essential that the people raising them are legally recognized as their parents from the very beginning. Without that legal clarity, children can face uncertainty about who is responsible for their care, who can make decisions on their behalf, and who they are legally connected to.

Children born through donor conception deserve to start life with the security of having their intended parents legally recognized. This reduces the risk of family separation and ensures children have immediate access to health insurance, inheritance, and other legal rights through both parents.

This new law will help make that a reality by ensuring that intended parents are recognized as legal parents.

The act also allows for a Voluntary Acknowledgement of Parentage (VAP), which is a simpler, streamlined, and more affordable way of establishing parentage
