Please note that specific sections of the Medicare physician fee schedule have undergone modifications. For instance, Illinois zones 12 and 99 experienced a fee increase of approximately 1.5% as of last week. It is advisable for all to reverify their fee schedule for their state carrier and respective zone.

Due to the mobilization of chiropractors and their patients in resistance to the pre-authorization mandate for care, Medicare Advantage United Healthcare has stopped the pre-authorization mandate for therapy and chiropractic services beginning January 13, 2025. Prior authorization will no longer be necessary for the first 6 visits of a care plan, provided those visits occur within an 8-week period.

On Dec. 26, 2024, the 5th Circuit Court reversed an earlier stay, reinstating a preliminary injunction that prevents the Financial Crimes Enforcement Network (FinCEN) from enforcing the BOI filing requirements:

“However, in order to preserve the constitutional status quo while the merits panel considers the parties’ weighty substantive arguments, that part of the motions-panel order granting the Government’s motion to stay the district court’s preliminary injunction enjoining enforcement of the CTA and the Reporting Rule is VACATED”

This ruling concludes that, while the court considers the appeal, the injunction stands, and BOI reporting is not required until a court decision is reached, providing a clear status update.

You do not have to do it right now...

BUT...I have been told by reliable sources, that this will eventually be required.

Congress passed a stopgap bill to keep the government funded until March 14, 2025. The bill now goes to President Biden’s desk to be signed on Saturday.

All of the expiring health care programs were extended until March 14. However, in a devastating move for Medicare physicians and patients, the language from the bipartisan deal reached earlier this week that would have stopped most of the Medicare physician payment cut was stripped out of the bill. Therefore, the 2.8% Medicare payment cut will go into effect on January 1, 2025. When medical practice inflation is factored in, this is in effect a 6.4% payment cut to physicians. More to come.

The Medicare open enrollment period for provider participation during calendar year (CY) 2025 is from November 15 through December 31, 2024. It is illegal for chiropractors to opt out of Medicare. If you see Medicare-eligible patients, you must be enrolled in Medicare as participating or non participating. Providers who want to maintain their current participation status, participating or non-participating, do not need to take any action during this annual participation enrollment program. HHS and the Office for Civil Rights (OCR) have released version 3.5 of the Security Risk Assessment (SRA) Tool. Conducting a Security Risk Assessment is REQUIRED annually to be done by all providers to identify and assess potential risks and vulnerabilities to electronic protected health information (ePHI). The downloadable SRA Tool is a desktop application that walks users through multiple-choice questions to help identify and assess potential risks and vulnerabilities to ePHI. It is mandatory that all offices conduct the Security Risk Assessment. The tool is designed that you may begin the assessment, save it, and return it anytime until it is completed. CMS released a memo today reminding all Medicare providers, that you may not bill Medicare beneficiaries in the Qualified Medicare Beneficiary (QMB) eligibility group for Medicare Part A or Part B covered services. This includes Medicare Part B deductibles, coinsurance, and copayments for covered services. You can check the status of your Medicare patients online to see if they are a QMB status or the EOB will alert you if they are a QMB. Federal law prohibits all Original Medicare and MA providers and suppliers (not only those that accept Medicaid) from billing QMBs for covered services. This does not pertain to services other than spinal manipulation. Violators of this rule may be subject to sanctions if they don’t follow QMB billing prohibitions (even when Medicaid pays nothing). Sections 1902(n)(3)(B), 1902(n)(3)(C), 1905(p)(3), 1866(a)(1)(A), and 1848(g)(3)(A) of the Social Security Act have more information.
