The coexistence of indigenous law and Western law in South Africa presents a complex and often unrealistic dynamic. This interplay is shaped by historical, cultural, and legal factors that influence how justice is administered in the country.

The imposition of Western legal systems during colonial and apartheid eras marginalized indigenous legal practices. Despite the formal recognition of customary law in the post-apartheid Constitution, the legacies of exclusion still impact its application.

Indigenous law often emphasizes community and restorative justice, focusing on reconciliation and social harmony, while Western law tends to prioritize individual rights and punitive measures. This fundamental difference can lead to conflicts in legal interpretation and application.

South Africa recognizes both systems, yet the integration remains challenging. Indigenous law is often seen as inferior or non-binding, especially in formal legal settings. This creates a situation where indigenous communities may not fully trust or engage with the Western legal system.

Many indigenous people face barriers in accessing Western legal institutions, including language, resources, and understanding of the legal processes. This disparity can result in a lack of representation and fairness in the legal system.

Efforts to harmonize these legal frameworks include policies aimed at recognizing and integrating indigenous law into the formal legal system. However, these reforms often lack the necessary resources and political will to be effective.

In conclusion, while there is potential for coexistence between indigenous and Western law in South Africa, the realities on the ground often complicate this relationship, leading to an unrealistic balance that requires ongoing dialogue and reform. Addressing these challenges involves recognizing the value of both legal systems and fostering respect and understanding between them.

Since 2022 Togu Healing Institute started researching and studying the pharmacology research done on indigenous medicine. We selected few plants and Gunnera perpensaL./ River pumpking/iphizi/ithanga lamanzi/ungobhe was one of them.

Gunnera perpensa L. is a medicinal plant used in many parts of South Africa by traditional healers to treat several human ailments such as; Menstruation pains and problems, female infertility,urinary tract, induced labour, wound dressing, Colds and others

Spiritual uses: dream and vision clearing

Pharmacology research:

A number of phenolic com-pounds have been isolated from the stem, root andrhizome of G. perpensa. Phenolic compounds can beheld responsible for a wide variety of biological activi-ties including antiseptic, antimutagenic, anticancer, anti-haemorrhagic and antioxidative properties (Brookes and Dutton 2007). These properties could be helpful during pregnancy and birth, which confirms some of the reported health effects accredited to this species by traditional healers.
