On Saturday myself and Courtney Campbell of Development Solutions Victoria had the pleasure of attending the official opening of the Mallacoota and District Tool Library.
We were involved with the building design and Planning application process respectively to enable the committee to get approval to build this amazing space and community initiative.
On a side note...the food from Frenchies of Mallacoota was awesome.

🌳 Important Update: New Laws on Canopy Trees in Victoria 🌿

Heads up, folks, as of 15 September 2025, Victoria introduced Clause 52.37 (Canopy Trees) in all planning schemes under Amendment VC289.

Here’s what you need to know if you’ve got trees or plan to do any work on residential land:

🔍 What is a “Canopy Tree”?
To be classed as a canopy tree under this law, a tree must meet all three:
Height more than 5 metres above ground level and
Trunk circumference greater than 0.5 metres (measured at 1.4 m above ground) and
Canopy diameter of at least 4 metres.

🚫 When You’ll Need a Permit
You’ll need a planning permit before you remove, destroy or lop a canopy tree in certain residential zones, UNLESS your land is in a Low Density Residential Zone, which is excluded.

Some specific triggers for needing a permit:
> If the property is vacant and you propose a single dwelling.
> If work is done within 6 m of the narrowest street frontage OR 4.5 m of the rear boundary, even if there’s already a house and you’re doing extensions or building additions.

⚠️ What This Means for Homeowners & Developers
> Don’t assume a building permit alone covers tree removal if it meets the canopy tree definition. You’ll need to sort out planning permissions first.
> Before digging out driveways, designing your extension, or removing trees, get a survey done showing where the trunk sits, how big the canopy is, and whether buffers (front/rear) apply. It can save you headaches.
> Engaging an arborist and/or landscape designer early helps—so you can plan for where to keep trees, where to plant new ones, and how to ensure replacement canopy meets the new rules.
