Do you know what your responsibilities are as an NDIS worker when reporting concerns related to the care and safety of vulnerable people??
All NDIS participants have the right to access safe and ethical supports and services. The NDIS Code of Conduct helps providers, key personnel and workers respect and uphold those rights by defining expected conduct, behaviour and culture.
You’ve phoned and reported it to the Support Coordinator, what else should you do?
All NDIS providers and their employees are responsible for reporting to the appropriate departments and authorities when a person with a disability's safety and wellbeing is at risk. Reporting safety concerns ONLY to an NDIS Support Coordinator is not complying with the NDIS Code of Conduct. While it is important for a participants Support Coordinator to be informed of safety concerns, NDIS Support Coordinators roles DO NOT include taking on the responsibility of another NDIS providers Code of Conduct reporting compliance.
Who should you report to?
• The Ageing and Disability Commission handles reports about adults with disability and older people who are subject to, at risk of, or living in circumstances that will result in abuse, neglect and exploitation in their family, home and community. https://ageingdisabilitycommission.nsw.gov.au
• The NDIS Quality and Safeguards Commission handles complaints about the conduct of NDIS providers and staff. https://www.ndiscommission.gov.au/

Who else should I talk to or what more should I do?
• Complete detailed WRITTEN incident reports
• Notify line Managers if you work for an organisation
• If needed report immediately to authorities like the Police
• Notify Guardian or Nominee
• Notify the participants Support Coordinator

NDIS Code of Conduct Education!
Being educated about your responsibilities relates to everyone working in an NDIS role including managers, direct supports, cleaners and gardeners. Everyone should fully understand their compliance requirements and take all reasonable steps to prevent and respond to incidents relating to an NDIS participant.

The NDIS Code of Conduct states in section five and six that:
5 Persons covered by the NDIS Code of Conduct
(1) This Part is made for the purposes of section 73V of the Act.
(2) Both of the following are Code covered persons:
(a) NDIS providers;
(b) persons employed or otherwise engaged by NDIS providers or members of the key personnel of NDIS providers.
(3) Code covered persons must comply with the NDIS Code of Conduct set out in section 6 of this instrument.
6 NDIS Code of Conduct
(1) In providing supports or services to people with disability, a Code covered person must:
(a) act with respect for individual rights to freedom of expression, self determination and decision making in accordance with applicable laws and conventions; and
(b) respect the privacy of people with disability; and
(c) provide supports and services in a safe and competent manner, with care and skill; and
(d) act with integrity, honesty and transparency; and
(e) promptly take steps to raise and act on concerns about matters that may impact the quality and safety of supports and services provided to people with disability; and
(f) take all reasonable steps to prevent and respond to all forms of violence against, and exploitation, neglect and abuse of, people with disability; and
(g) take all reasonable steps to prevent and respond to sexual misconduct
