Do you know what your responsibilities are as an NDIS worker when reporting concerns related to the care and safety of vulnerable people??

All NDIS participants have the right to access safe and ethical supports and services. The NDIS Code of Conduct helps providers, key personnel and workers respect and uphold those rights by defining expected conduct, behaviour and culture.

You’ve phoned and reported it to the Support Coordinator, what else should you do?

All NDIS providers and their employees are responsible for reporting to the appropriate departments and authorities when a person with a disability's safety and wellbeing is at risk. Reporting safety concerns ONLY to an NDIS Support Coordinator is not complying with the NDIS Code of Conduct. While it is important for a participants Support Coordinator to be informed of safety concerns, NDIS Support Coordinators roles DO NOT include taking on the responsibility of another NDIS providers Code of Conduct reporting compliance.

Who should you report to?
• The Ageing and Disability Commission handles reports about adults with disability and older people who are subject to, at risk of, or living in circumstances that will result in abuse, neglect and exploitation in their family, home and community. https://ageingdisabilitycommission.nsw.gov.au
• The NDIS Quality and Safeguards Commission handles complaints about the conduct of NDIS providers and staff. https://www.ndiscommission.gov.au/

Who else should I talk to or what more should I do?
• Complete detailed WRITTEN incident reports
• Notify line Managers if you work for an organisation
• If needed report immediately to authorities like the Police
• Notify Guardian or Nominee
• Notify the participants Support Coordinator

NDIS Code of Conduct Education!

Being educated about your responsibilities relates to everyone working in an NDIS role including managers, direct supports, cleaners and gardeners. Everyone should fully understand their compliance requirements and take all reasonable steps to prevent and respond to incidents relating to an NDIS participant.

The NDIS Code of Conduct states in section five and six that:

5 Persons covered by the NDIS Code of Conduct
(1) This Part is made for the purposes of section 73V of the Act.
(2) Both of the following are Code covered persons:
(a) NDIS providers;
(b) persons employed or otherwise engaged by NDIS providers or members of the key personnel of NDIS providers.
(3) Code covered persons must comply with the NDIS Code of Conduct set out in section 6 of this instrument.

6 NDIS Code of Conduct
(1) In providing supports or services to people with disability, a Code covered person must:
(a) act with respect for individual rights to freedom of expression, self determination and decision making in accordance with applicable laws and conventions; and
(b) respect the privacy of people with disability; and
(c) provide supports and services in a safe and competent manner, with care and skill; and
(d) act with integrity, honesty and transparency; and
(e) promptly take steps to raise and act on concerns about matters that may impact the quality and safety of supports and services provided to people with disability; and
(f) take all reasonable steps to prevent and respond to all forms of violence against, and exploitation, neglect and abuse of, people with disability; and
(g) take all reasonable steps to prevent and respond to sexual misconduct

📣 Have your say and help shape Thriving Kids.

Thriving Kids is a national initiative to improve services and support for children aged 8 and under with developmental concerns or mild to moderate disability.

Families, carers, community members and professionals can share their experiences with support services for children with disability, including developmental delay and autism.

You can participate by either:
🔸 making a written submission by Friday 3 October 2025
🔸 completing a short community survey by Friday 10 October 2025.

We’ve just launched Restrictive Practices and Me, a collection of resources that support meaningful conversations with participants about restrictive practices.

The resources include discussion books in Easy Read and Plain English formats. They can be used to explain restrictive practices in an easy to understand way.

Restrictive Practices and Me was created in collaboration with people with disability, providers, state and territory governments, and the Council for Intellectual Disability.

The Attorney-General’s Department is reviewing the Disability Discrimination Act 1992 (Cth). The purpose of the review is to implement 15 recommendations from the Disability Royal Commission and ensure the Disability Discrimination Act remains fit for purpose.

Are you an NDIS participant or plan nominee and would like information about the new Funding Periods, the NDIS have spots left at their upcoming webinars.

Funding periods define how often a participant can access a portion of their funding and how long it needs to last.

🧠 What is an NDIS check-in?
📞 A check-in is a short talk with the NDIS.

🗣️ The NDIS may call or meet with you.

🧾 This is not a new thing. It has happened for a few years.

🔁 What can happen in a check-in?

👂 The NDIS listens to what you say.

🛠️ If they hear something that means your plan might need to change, they might change it.

🧍‍♂️ You can ask for a plan change during a check-in.

🤔 But the NDIS planner can say yes or no to a change.

😕 Sometimes the NDIS makes a new plan after a check-in

📝 Some people got a new plan after a check-in.

😲 Sometimes they did not know this would happen.

🚫 It should not happen like this.

📣 But we know it still happens.

✔️ If you like your current plan and are happy

📱 Keep your check-in call very short.

👍 Say you are happy and want no changes.

🤐 Do not say anything that sounds like a problem.

⚖️ But… the planner can still change your plan if they want to.

📵 You do not have to talk right away

📆 If the NDIS calls, you can ask for them to call back another time.

🕒 Choose a time that works best for you.

🧠 Think about your plan before you talk to the NDIS.

❓ Decide if you want a new plan or not.

😮 This helps you speak to them and not get surprised when the NDIS calls you.

🚫 Do not ignore the check-in

📞 If you avoid calls for too long, the NDIS may make a new plan anyway.

⛔ Ignoring them will not stop changes.

🧭 It is better to be prepared and answer.

From Monday, 19 May 2025, the NDIS National Disability Insurance Scheme will implement a change in how funding is released for all new and reassessed plans.

Participants will now receive funds distributed in scheduled instalments known as “funding periods,” rather than accessing all the funds at the beginning of their plan.

Section 33: NDIS Plan Funding Periods Change Begins 19 May 2025

From Monday 19 May 2025, the NDIS will activate funding periods (instalments) in PACE for all new plans. New Plans will be broken into funding periods—typically quarterly (every 3 months), with Home & Living supports issued monthly.

This only applies to new plans approved from 19 May 2025. Existing PACE plans (pre 19 May 2025) that already have 12-months funding built in
won’t change.

NDIA/PRODA portal visibility will change and funding will be seen by period, not total budget.

Support Coordinators, Plan Managers and Providers will need to navigate new claiming rules, separate invoicing by period, and monitor portal updates.

Important notes for all participants and their providers:

⭐️If a support category has insufficient funds in a funding period, claims will be rejected in full—not partially paid.
⭐️Invoices that span across funding periods must be split and submitted separately.
⭐️Service Agreements will now need to align with funding periods.
⭐️Support Coordination hours should be justified to be funded over a 12-month period, not locked into quarterly allocations.

This change has come with very limited notice for Plan Managers, Support Coordinators, providers and participants allowing only days notice to prepare for the changes.

Participants wanting further information to understand the changes should reach out to their Support Coordinators and/or Plan Managers. Participants can also contact their LAC or the NDIS directly.

Providers wanting further information to support delivery of services should contact the NDIS Provider Support dept by calling 1800 800 110.
