Working overtime?

Some awards and enterprise agreements let you take paid time off instead of being paid overtime rates for working outside your ordinary hours. This is also known as time in lieu (TIL) or time off in lieu (TOIL).

If you choose to take TOIL, it’s important to remember that most awards say you need a written agreement with your employer.

Most awards also say you can’t be forced to take TOIL instead of being paid for overtime.

NDIS providers must act swiftly to report and manage serious incidents.

Under NDIS legislation, registered providers must notify the Commission within 24 hours of first becoming aware of serious incidents connected to NDIS supports. This includes:

🚨 death or serious injury of a person with disability
🚨 abuse or neglect
🚨 unlawful sexual or physical contact, or assault
🚨 sexual misconduct against, or in the presence of, a person with disability.

These requirements also apply to alleged incidents.

Reports must fully document the incident and actions taken to protect the participant's safety and wellbeing. Submissions are made via the Registered Providers Portal: https://bit.ly/4jniWG2.

Delays in reporting or failure to notify the Commission can result in enforcement action including fines, banning orders, or other compliance measures.

The first NDIS Worker Screening Checks issued in 2021 have now reached their renewal period, marking an important milestone for the NDIS Commission.

Workers whose clearances are reaching expiry will receive renewal notifications from the state or territory authority that issued their Check. The NDIS Worker Screening Database (NWSD) is also notifying employers – including registered and unregistered providers, and self-managed participants – when workers linked to them in the NWSD need to renew.

Workers with Checks due to expire within 90 days must apply to renew so they can continue working in risk-assessed roles. Providers are required to remove workers from these roles if their clearance expires.

Workers who'd like to check the expiry date of their Worker Screening Check can either:

• Refer to the confirmation material sent to them by the state or territory authority that issued their Check
• Request this information from their employer (to which the worker should be linked on the NWSD)
• Refer directly to the state or territory authority that issued their Check
