The problem is they spend uncapped amounts investing in compliant companies. Smileys was investigated. Why? Because the director’s daughter was murdered. The commission falsely stated we were involved in a Queensland police investigation. This was completely incorrect, as we were supporting the Queensland Police in investigating my daughter’s disappearance and subsequent murder. Smileys had no previous commission inquiries and had passed our mid-term audit in 2024 with a minor non-compliance issue, which was that we hadn’t received feedback about our service delivery. We run separate CRMs for our Support Services, Support Coordination, and PRC. The way we were treated by both the NDIS and the Commission was absolutely horrendous, and Smileys office staff, participants, and their families were and still are significantly traumatized by the whole event. So, maybe a royal commission into the NDIS and the NDIS Commission is actually what’s called for.
The Australian Competition and Consumer Commission (ACCC) has released a new report highlighting consumer issues within the NDIS and outlining key rights and obligations for participants and providers.
The report, ACCC observations of consumer issues in the NDIS, raises concerns about non-compliance with Australian Consumer Law, including unfair practices that can cause financial harm and compromise the safety and wellbeing of people with disability.
Ross Joyce, AFDO CEO said: This is an important report and there are some disturbing findings of some provider activities. I caon the NDIS Quality & Safeguard Commissioner and the NDIA to take urgent action to address these, strengthen consumer protections and improve accountability across the Scheme. We need to ensure that participants understand their rights, and that providers uphold their obligations which are essential to maintaining trust and integrity within the sector.
