📣 From 26 August 2025, employees in small businesses (fewer than 15 staff) have a right not to answer work calls, emails, or messages outside your hours—unless it’s reasonable or urgent.

💡This is a big step for workplace mental health and work–life balance, giving workers in small businesses the same right as those in larger businesses. But it also means employers and employees need open conversations about how to navigate these new laws within the unique business and operational needs of a small business.

While this work ethic can lead to professional success, it often comes at a steep cost: mental health. Burnout, chronic stress, and exhaustion are widespread in these sectors, yet many industries fail to address these challenges effectively, neglecting both their workforce and overall productivity.

💡According to EML's latest white paper, there was 13,379 accepted worker compensation claims for mental injury in Australia in 2021-22 — and workers in some industries face higher mental health risks.

Research into workplace mental health is critical to help us better understand the state of Australian workplaces, the specific psychosocial risks workers face and to ultimately improve workplace mental health outcomes in Australia.

According to the People at Work Survey, workers in the health care and social assistance industry are much more likely to experience workplace violence, particularly angry or hostile behaviour (50%, compared to 41% across all industries).

Frontline workers deserve better workplace mental health, which is why we’re glad to see the industry’s new code of practice launched this month. The Code guides duty-holders on how to manage risks in the workplace and meet workers’ health and safety needs.

💡Mental health claims among the nursing, care and support workforce have almost doubled in the last 10 years. The majority of claims (8 out of 10) are reactions to workplace stressors and post-traumatic stress disorder.

📄This month, Safe Work Australia published the industry’s new code of practice, created to help employers better meet their workplace health and safety duties, including protecting workers’ mental wellbeing.

A new report by the Productivity Commission has dispelled fears about remote work, finding that working from home, for part of the week, can actually increase worker productivity.

Hybrid work arrangements allow employees to split their time between home and in-person. This can greatly benefit job satisfaction, and cut commute times, sick days and distractions – all of which can boost productivity.

Too many employees are unaware of the extent of surveillance in their workplaces. This lack of transparency can damage workplace relationships, create a toxic workplace culture and negatively affect workers’ mental health.

It’s important that workplace surveillance follows healthy workplace mental health measures, including consultation, transparency and managing associated mental health risks.

Excessive workplace surveillance can seriously harm mental health, according to a recent inquiry by the Victorian Parliament. Workplace surveillance is a common practice with 61% of workplaces surveyed by the Victorian Trades Hall Council reporting they surveil workers.

However, increasing and deepening surveillance, such as keystroke tracking and audio recording, can cause workers undue anxiety, pressure and stress.

Intrusive surveillance was recently added to the Commonwealth Code of Practice as an emerging psychosocial hazard, meaning at work, we need to ensure surveillance practices are transparent, necessary, and proportionate. We’re taking action to protect workplace mental health

Work is a significant factor in people’s mental health. We know that meaningful, rewarding, good work can impact positively on our mental health. Equally we know that issues such as high workloads, customer and client aggression and poor workplace relationships can adversely impact on workers’ mental health.

This campaign is about recognising the impact that the workplace itself has on workers’ mental health. Mind Your Head encourages action in workplaces to address mental health hazards – just like we would take action on a slip hazard.

THE PROBLEM

Just like physical health and safety hazards, such as slippery surfaces, dangerous and unguarded machinery and badly set-up work stations, there are also workplace mental health hazards, like high workloads, isolated work and poor role clarity.
