Rachel asks: If you request a roll-over do you have a right to a yes? Surely we all deserve a rest from fighting?
Sam answers:
Nup.
You don’t have a “right” to a rollover (which is actually called a Plan Renewal if you want a new, repeat plan of your previous plan).
You do have a right to “Reasonable and Necessary” funding though.

A rest from the fighting would be delightful, I hear you.
Especially if you’ve had an S100 Review of a Reviewable Decision review, and the outcome was good – ain’t no participant wanna muck with that eh?
So, what will give you the best chance of a plan renewal?
I suggest that you:
a) Call the NDIS/LAC three months before your plan is due to end and ask for a “Plan Renewal”.
b) If the planner/LAC asks what has changed in your life and how things are going, and you haven’t had any changes that would change your funding requirements, then just zip those lips and answer with “No changes, everything is fine, thanks”
And you should know that:
c) If you say stuff like “I didn’t have enough core” or “I don’t need all that therapy money but the rest is OK” or “I want to change my goals” or “There’s no way we could have spent all that last year” or “He is so distressed and his behaviour has really escalated and I’m worried about him”, you will probably trigger a full Plan Review, or at least a Light Touch Renewal. If these things are true of your situation, then you should probably actually consider asking for a Plan Review so your needs are met!
d) If your current plan is outside of the Typical Support Package (TSP = a broad estimation of funding requirements for the “average” person of your age with your disability, functional impairment and living arrangement) then you will likely have a full Plan Review regardless of what you say.
There are no guarantees with this stuff. Sorry.
Everybody's situation is different and your mileage may vary!
Also check the date on this response - if t's more than a few months old by the time you read it, it may well be out of date!
