From today, children 5-11 years of age can be vaccinated. We have already seen a steady rise in covid vaccination applications, mostly relating to children either being given the vaccine or being denied access to an unvaccinated parent. I have a feeling these matters will continue for a while, especially now even younger children are eligible.

The courts have seen a rise in the number of claims related to vaccination and children, but also disputes where one parent has stopped letting their child spend time with the other unvaccinated parent.

Another example of why we need a specialist Family Law court...

"In a judgment in February 2019, the Full Court of the Family Court – Justices Steven Strickland, Peter Murphy and Michael Kent – set aside the orders made by Judge Vasta and labelled the situation a "gross miscarriage of justice".

"We are driven to conclude that the processes employed by the primary judge were so devoid of procedural fairness to the husband, and the reasons for judgment so lacking in engagement with the issues of fact and law to be applied, that to permit the declaration and order for imprisonment to stand would be an affront to justice," the court found.

The man, who cannot be named, was jailed during family law proceedings and later strangled and bashed in custody, it is alleged in court documents.

“They kept telling me, ‘Anything could happen here’,” sums up how discretionary the family court can be. However, dismantling it s a stand alone court is not the answer. Rather fixing it with more resources seems to be the obvious way to reduce wait times.

The Family Court of Australia was once the envy of the developed world for the way it approached disputes between separating couples. Now the government wants to do away with it. What went wrong?

Clearly more resources are needed, rather than taking the much needed specialist Family Court away!

Clearly more resources are needed, rather than taking the much needed specialist Family Court away!

The Sydney registry of the Family Court has a "win at all costs" reputation. But proposed reforms will give judges the ability to order lawyers to personally bear the costs and to dismiss applications without merit.

We are already seeing the results of a very stressful year for families where cracks became canyons coupled with an already strained legal system at breaking point. Mediation can be a very effective way for families to circumvent being trapped in this system and to be able to start their healing process of separation, rather than being further traumatised.

Family lawyers fear delays could worsen amid a rush of people seeking advice about separation and parenting arrangements.

Interesting article in the paper this week. Hopefully these suggestions will be actioned!

It is not often a court strongly discourages litigation, but the family courts are far from typical courts.
