বিয়েকে অবশ্য আইনি চুক্তি হিসেবে বিবেচনা করা হয়, যেখানে কাবিননামা বা নিকাহনামাকে প্রামাণ্য দলিল হিসেবে দেখা হয়। চলুন কাবিননামার প্রধান ০৮ টি বিষয় সম্পর্কে জেনে নেওয়া যাক।
মোহরানা
প্রথাগতভাবে বিয়ের সময় মোহরানার (সাধারণত দেনমোহর নামে পরিচিত) অংশ অনেক বেশি অগ্রাধিকার পায় এবং ধর্মীয়ভাবে মোহরানা কনের নিরাপত্তা হিসেবে দেওয়া হয়। পারিবারিক অনুশীলন, বরের আয় ও পরিবারের সিদ্ধান্ত বিবেচনা করে দেনমোহরের পরিমাণ নির্ধারণ করার পরামর্শ দেওয়া হয়। সমাজে মোহরানার ভূমিকা যেভাবে দেখা হয়, এর বাইরেও এটি অনেকভাবে মূল্যায়িত হতে পারে।
দেনমোহর প্রদান
কাবিননামায় মোহরানার পরিমাণের পাশাপাশি কখন এবং কীভাবে মোহরানা দেওয়া যেতে পারে সে বিষয়ে শর্ত নির্ধারণ করা হয়। সবার আগে দেনমোহর কোনো সম্পত্তি বা গয়না হিসেবে দেওয়া হচ্ছে কি না, কতটা বকেয়া আছে এবং বকেয়ার পরিমাণ কিস্তিতে নাকি এককালীন পরিশোধ করা হবে ইত্যাদি বিষয় কাবিননামায় উল্লেখ করতে হয়।
বিচ্ছেদের অধিকার
কাবিননামার একটি ধারায় স্ত্রীর তালাক দেওয়ার অধিকার থাকতে পারে। একজন স্ত্রী মুসলিম আইন অধ্যাদেশ- ১৯৬১ অনুযায়ী বিয়ে ভেঙে দেওয়ার অধিকার প্রয়োগ করতে পারেন। তবে এটি শর্তসাপেক্ষ হতে পারে।
স্বামীর বিচ্ছেদের অধিকার সীমিতকরণ
মুসলিম বিয়েতে তালাক দেওয়ার চূড়ান্ত অধিকার স্বামীর। তবে কিছু নিয়মনীতির মাধ্যমে স্বামীর এই অধিকার সীমিত করা যেতে পারে। বিয়ের নিরাপত্তা বৃদ্ধি করে চুক্তিতে শর্ত উল্লেখ করা যেতে পারে। তবে সব শর্তই দম্পতি কী চায় তার ওপর সম্পূর্ণ নির্ভরশীল।
দম্পতির 'উকিল'
কাবিননামা দম্পতিকে 'উকিল বাবা' বাছাইয়ের অনুমোদন দেয়। তিনি দম্পতির অধিকারের বিষয়ে পরামর্শ দেবেন এবং তাদের দাম্পত্য জীবনে কোনো বিবাদ দেখা দিলে তা সমাধানে কাজ করবেন।
সাক্ষী
কাবিননামা চুক্তি সইয়ের সময় উভয় পক্ষ থেকে কমপক্ষে ২ জন সাক্ষী উপস্থিত থাকতে হবে এবং কাবিননামায় সাক্ষীদের সঙ্গে যোগাযোগের বিবরণ উল্লেখ করতে হবে। কারণ, বিবাদের ক্ষেত্রে সাক্ষীরা যেন ঘটনা যাচাইয়ের জন্য নিরপেক্ষ পক্ষ হিসেবে কাজ করতে পারেন।
আগের বিয়ের বিবরণ
কনে আগে কোনো বিয়ে করে থাকলে তার বিবরণ কাবিননামায় উল্লেখ করতে হবে। তাকে বিয়ে ভাঙার কারণ, যেমন তালাক, মৃত্যু বা অন্যান্য কারণ উল্লেখ করতে হবে।
বহুবিয়ের ক্ষেত্রে কাউন্সিলের অনুমতি
মুসলিম ব্যক্তিগত আইন অনুযায়ী একজন পুরুষ সর্বোচ্চ ৪ নারীকে বিয়ে করতে পারেন। এ ক্ষেত্রে বরকে সালিশি পরিষদ থেকে লিখিত অনুমতি নিতে হবে। কাবিননামায় সালিশি পরিষদের কাছ থেকে পাওয়া অনুমতির বিবরণ থাকতে হবে। এ অনুমতি ছাড়া বিয়ে করা শাস্তিযোগ্য অপরাধ।

It can be evaluated in many ways, beyond how the role of dowry is seen in society.
Payment of dowry
In addition to the amount of dowry, the Kabinnama sets conditions on when and how the dowry can be paid. First of all, the Kabinnama should mention whether the dowry is being given in the form of any property or jewelry, how much is due, and whether the amount due will be paid in installments or in a lump sum.
Right to divorce
A clause in the marriage contract may provide for the wife to have the right to divorce. A wife can exercise her right to dissolve the marriage under the Muslim Laws Ordinance, 1961. However, this may be conditional.
Limiting the husband's right to divorce
In a Muslim marriage, the husband has the ultimate right to divorce. However, this right of the husband can be limited by some rules. Conditions can be mentioned in the contract to increase the security of the marriage. However, all the conditions are completely dependent on what the couple wants.
The couple's 'lawyer'

If the bride has had any previous marriages, the details must be mentioned in the marriage certificate. She must mention the reason for the dissolution of the marriage, such as divorce, death or other reasons.
Permission from the council in case of polygamy
According to Muslim personal law, a man can marry a maximum of 4 women. In this case, the groom must obtain written permission from the Arbitration Council. The marriage certificate must contain the details of the permission obtained from the Arbitration Council. Getting married without this permission is a punishable offense.
