08 things you need to know about Kabinnama
Marriage is, of course, considered a legal contract, where Kabinnama or Nikahnama is seen as a documentary document. Let's learn about the 08 main things of Kabinnama.
Mohran
Traditionally, the portion of the dowry (commonly known as deenmohar) gets much more priority during marriage and religiously, the dowry is given as security for the bride. It is advisable to determine the amount of dowry by considering family practices, the groom's income, and the family's decisions. It can be evaluated in many ways, beyond how the role of dowry is seen in society.
Payment of dowry
In addition to the amount of dowry, the Kabinnama sets conditions on when and how the dowry can be paid. First of all, the Kabinnama should mention whether the dowry is being given in the form of any property or jewelry, how much is due, and whether the amount due will be paid in installments or in a lump sum.
Right to divorce
A clause in the marriage contract may provide for the wife to have the right to divorce. A wife can exercise her right to dissolve the marriage under the Muslim Laws Ordinance, 1961. However, this may be conditional.
Limiting the husband's right to divorce
In a Muslim marriage, the husband has the ultimate right to divorce. However, this right of the husband can be limited by some rules. Conditions can be mentioned in the contract to increase the security of the marriage. However, all the conditions are completely dependent on what the couple wants.
The couple's 'lawyer'
The marriage contract allows the couple to choose a 'lawyer father'. He will advise the couple on their rights and work to resolve any disputes that arise in their marital life.
Witnesses
At least 2 witnesses from both parties must be present at the time of signing the marriage contract and the contact details of the witnesses must be mentioned in the marriage contract. This is because in case of a dispute, the witnesses should be able to act as impartial parties to verify the facts.
Details of previous marriages
If the bride has had any previous marriages, the details must be mentioned in the marriage certificate. She must mention the reason for the dissolution of the marriage, such as divorce, death or other reasons.
Permission from the council in case of polygamy
According to Muslim personal law, a man can marry a maximum of 4 women. In this case, the groom must obtain written permission from the Arbitration Council. The marriage certificate must contain the details of the permission obtained from the Arbitration Council. Getting married without this permission is a punishable offense.
