Starting January 21, 2025, there are new rules from Immigration, Refugees and Citizenship Canada (IRCC) about work permits for family members of workers and students in Canada.

For Spouses:

Spouses of international students: Only those whose partners are enrolled in certain programs (like master’s or doctoral programs) can apply for an open work permit (OWP).

Spouses of foreign workers: Only those whose partners work in high-demand jobs (like healthcare, construction, and certain skilled positions) can apply for an OWP. The worker must have at least 16 months left on their work permit when applying.

For Dependent Children:
Dependent children of foreign workers or students are no longer eligible for an open work permit.

Existing Work Permits:

If a family member has already been approved for an open work permit, it will remain valid until it expires.
Family members can apply to renew their permits if they meet the new rules.

As of December 23 at 11:59 pm ET, work & study permits will not be provided to flagpolers at ports of entry, freeing up resources for CAN & US officers to focus on securing our shared border.

Flagpoling is when foreign nationals who hold temporary resident status in Canada, leave Canada and, after a visit to the United States or St. Pierre and Miquelon, re-enter to access immigration services at the border.
