ስለመብቱ አፈጻጸም Implementation of the Right
1. የእኩል መስተንግዶ መርህ 1. Principle of Equal Treatment
1. በክልሉ ውስጥ የገጠሩና የከተማው ነባራዊ ሁኔታዎች የተለያዩ ከመሆናቸው የተነሳ የመኖሪያ ቤትም ሆነ የዚሁ መስሪያ ቦታ አሰጣጥ ስርዓቱ የሚለያይ መሆኑ እንደተጠበቀ ሆኖ በሁሉም አካባቢዎች ተመድበው በሚያገለግሉ መምህራን መካከል የዚህን ደንብ ድንጋጌዎች አተገባበር አስመልክቶ ብሄር--ብሄረ-ሰብን፣ ሀይማኖትን፣ ማህበራዊ አመጣጥንና የመሳሰሉትን ጉዳዮች መሰረት ያደረገ አንዳች አይነት ልዩነት አይደረግም፡፡ ሁሉም ያለአድልዎ የመስተናገድና በእድሉ እኩል የመጠቀም መብት ይኖራቸዋል፡፡ 1. Due to the fact that the natural conditions of rural and urban areas are quite different throughout the Regional State, without prejudice to the prevailing disparity in the delivery system of dwelling house and land for the construction of same, no discrimination shall be made amongst teachers duly assigned to serve in all localities on the basis of nation-nationality, religion, social origin and the like matters with regard to the implementation of the provisions of this regulation. All shall be treated without discrimination and have the right to equally enjoy with the opportunity thereof;
2. በክልሉ መንግስት አማካኝነት የተሰራ መኖሪያ ቤት ያለ እንደሆነ መምህራን ይህንኑ እንዳግባብነቱ ከኪራይ ነጻ በሆነ መንገድ ወይም በተመጣጣኝ ኪራይ የማግኘት ወይም አገልግሎታቸው 2 ዓመትና ከዚያ በላይ በሆነ ጊዜ ለመኖሪያ ቤት መስሪያ የሚሆን ባዶ ቦታ የማግኘት መብት አላቸው፡፡ የመኖሪያ ቤትም ሆነ የባዶ ቦታ አሰጣጥ ስርዓቱ በተቻለ መጠን የተጠቃሚዎቹን ፍላጎት ያማከለ ይሆናል፡፡ 2. Teachers shall, where there exist dwelling houses constructed by the regional government, have the right to obtain same in a manner that is free from rent or with a reasonable amount of rent, as deemed appropriate, or a vacant plot of land for the purpose of constructing dwelling house where their services have been two years and above. The delivery system of the dwelling house or vacant plot of land shall conform with the interest of individual beneficiaries, as much as possible.
3. በዚህ አንቀፅ ንኡስ አንቀፅ (2) ስር የተደነገገው ቢኖርም መምህራኑ የደንቡ ተጠቃሚ ሊሆኑ የሚችሉት ከመኖሪያ መንደር፣ ከኮንዶሚኔም፣ መንግስት ከሚሰጠው የኪራይ ቤት ወይም በምሪት ቦታ ከተሰሩ ቤቶች መካከል አንደኛውን ብቻ በመምረጥ ይሆናል፡፡ 3. Notwithstanding the provision of Sub-Art. (2) of this Article hereof, teachers shall be able to become beneficiaries of the regulation only by preferring one from amongst the residential village, condominium, rental house to be provided for by the government or those houses constructed on the land permitted for the purpose.
2. ስለመምህራን ነጻ የመኖሪያ ቤትና ቦታ አሰጣጥ፡- 2. Delivery of Free Dwelling House and Land for Teachers
1. በንዑስ ማዘጋጃ-ቤቶች፣ በታዳጊ ከተሞችና በገጠር ቀበሌዎች ውስጥ በሚገኙ ትምህርት ቤቶች የሚያስተምሩ መምህራን፡- 1. Teachers who happen to teach at those schools found in sub-municipalities, emerging towns and rural Kebeles:
ሀ. ጉዳዩ በሚመለከተው ትምህርት ቤት ቅጥር ግቢ ወይም በዙሪያ አካባቢው በክልሉ መንግስት በጀት ወይም በአካባቢው ህብረተሰብ የቁሳቁስና የጉልበት ተሳትፎ በተሰሩ የመምህራን መኖሪያ መንደሮች ውስጥ በነጻ እንዲኖሩ ይደረጋል፤ A. shall be made to reside in the teachers’ residential villages duly constructed by the Regional Government budget or through the material and labor participation of the local community in the premises of the school concerned or the surrounding area;
ለ. እነዚሁ የመምህራን መኖሪያ መንደሮች በዋነኛነት በትምህርት ቤቱ ቅጥር ግቢ የመማር ማስተማሩን ስራ በማያውክ ርቀት ላይ ይገነባሉ፤ B. these teachers’ residential villages shall be constructed mainly in the premises of the school in a distance where they do not disturb the teaching-learning activity;
ሐ. በተባለው ትምህርት ቤት ቅጥር ግቢ ወይም በዙሪያ አካባቢው በቂ መሬት ያልተገኘ እንደሆነ አግባብ ያለው የቀበሌ አስተዳደር ጉዳዩ ከሚመለከታቸው አካላት ጋር ተመካክሮ በሚያመቻቸው አቅራቢያ ቦታ ላይ ይገነባሉ፡፡ C. Where adequate plot of land is not available in the premises of the said school or the surrounding area, the teachers’ residential houses shall be constructed nearby in a place to be set aside by the pertinent Kebele Administration in consultation with the organs concerned thereto.
2. በዚህ አንቀጽ ንኡስ አንቀፅ (1) ስር የሰፈረው አጠቃላይ ድንጋጌ እንደተጠበቀ ሆኖ አገልግሎታቸው 2ዓመትና ከዚያ በላይ የሆነ መምህራን በሚሰሩበት ትምህርት ቤት15 ኪሎ ሜትር ራዲየስ ውስጥ ከሚገኙት ከተሞች በመረጡት በአንደኛው በራሳቸው ወጪ የግል መኖሪያ ቤት መስራት እንደሚፈልጉ ገልፀው ያመለከቱ እንደሆነ የክልሉ መስተዳድር ምክር ቤት ለነባርና አዳዲስ የህብረት ስራ ማህበራት ጥር 12 ቀን 2009 ዓ.ም አሻሽሎ ባወጣው የመኖሪያ ቤት መስሪያ ቦታ አቅርቦትና የግንባታ አወሳሰን መመሪያ ቁጥር 28/2009ዓ.ም ውስጥ የተመለከተውን የማህበራት ቦታ ስፋት ልክ ሳያልፍ የጠየቁት የቤት መስሪያ ቦታ ሊሰጣቸው ይችላል፡፡ ይኸው በኮሚቴ እየተጣራ በንዑስ ማዘጋጃ-ቤት ከተሞች ሲሆን በሊዝ መነሻ ዋጋ፣ በታዳጊ ከተሞች ሲሆን ደግሞ በአመታዊ ኪራይ ተመን ይሰጣቸዋል፡፡ 2. Without prejudice to the general provision laid down under Sub-Art. (1) of this Article hereof, where teachers whose service has been two years and above notify that they preferentially desire to construct private dwelling houses on their own expense in one of the cities found within the radius of 15 kilometers from the school in which they work, they may be provided with the plot of land they have requested for the construction of house not exceeding the limit of the cooperative land size indicated under the Revised Dwelling Houses Construction Land Supply and Building Determination Directive No. 28/2017 which the Council of the Regional Government has issued on January 20 2017 for the benefit of the old and new cooperative societies. Such shall be scrutinized via a committee and be provided to them through an initial lease price, where the land is located in sub-municipalities, and through annual rental rate in the case of emerging towns.
3. በዚህ አንቀጽ ንዑስ አንቀጽ (2) ስር የሰፈረው ድንጋጌ እንደተጠበቀ ሆኖ በ15 ኪሎ ሜትር ራዲየስ ውስጥ ተፈላጊውን የከተማ ቦታ ማግኘት ያልቻሉ መምህራን ቢኖሩ በአቅራቢያቸው በሚገኙ የቀበሌ ማእከላት ውስጥ የጠየቁት የቤት መስሪያ ቦታ ሊሰጣቸው ይችላል፡፡ 3. Without prejudice to the provision laid down under Sub-Art. (2) of this Article hereof, should there exist teachers who have been unable to obtain the required urban land within the radius of 15 kilometers, they may be provided with the plot of land they have requested at the Kebele center located in their surroundings.
4. መምህራን በሚሰሩበት ወረዳ ውስጥ ካሉት ከተሞች መካከል ራሳቸው በመረጡት ከተማ ውስጥ የመኖሪያ ቤት ለመስራት የፈለጉ እንደሆነ መመሪያ ቁጥር 28/2009 ዓ.ም በሚፈቅደው መሰረት እንደማንኛውም ዜጋ 14ና ከዚያ በላይ እየሆኑ በማህበር ተደራጅተውና ከቤት መስሪያ ዋጋው 20 ከመቶ የሚሆነውን ገንዘብ መቆጠባቸውን አረጋግጠው ቦታውን ሊያገኙ ይችላሉ፡፡ 4. Where teachers desire to construct a dwelling house in the town they have preferred among the cities existing in the Woreda wherein they work, they may, having been organized in cooperatives of 14 in number and ascertained that they have managed to save the money to the amount of 20% of the total price for the construction of the house, obtain such land in accordance with the Directive No. 28/2017.
5. የዚህ አንቀጽ ንኡስ አንቀጽ (4) ድንጋጌ ቢኖርም ቀደም ሲል በማህበር ተደራጅተው የቤት መስሪያ ቦታ የተረከቡ መምህራን በዚሁ በተረከቡት ቦታ ላይ የአካባቢው አስተዳደር ያወጣውን ደረጃ የጠበቁ መኖሪያ ቤቶችን በራሳቸው ወጪ ሊገነቡ ይችላሉ፡ 5. Notwithstanding the provision of Sub-Art. (4) of this Article hereof, teachers who already had been organized in cooperatives and received land for the construction of houses may build same having maintained the standard set by the local administration on their expense at such land they have acquired thereof.
6. በከተማው ለመኖሪያ ቤት መስሪያ ከሚዘጋጀው ቦታ ውሥጥ ከ20-30 ከመቶ የሚሆነው ለመምህራን ቅድሚያ ተሰጥቶ ይመደባል፡፡ 6. 20 through 30% of the land to be prepared for the construction of dwelling houses in the city shall be allotted for teachers, having been given priority thereof.
7. በዚህ ደንብ ድንጋጌዎች መሰረት መምህራንን ተጠቃሚ ለማድረግ ሲባል የካሳ ክፍያ አስፈላጊ ሆኖ በሚገኝበት ጊዜ የክልሉ መንግስት ለተፈናቃዮቹ በህግ አግባብ ተገቢውን ካሳ በቅድሚያ በመክፈል ወይም ትክ ቦታ በመስጠት የቤት መስሪያ ስፍራውን ከሶስተኛ ወገን ነጻ ያደርጋል፡፡ 7. Where payment of compensation is a necessity to benefit teachers in accordance with the provisions of this regulation, the regional government shall make the land for housing construction free from third party by, in advance, disbursing the appropriate compensation in line with the law to the displaced persons or providing substitute plots of land for them.
3. በአነስተኛ ከተማ አስተዳደሮች ስር በተቋቋሙ ትምህርት ቤቶች ስለሚያስተምሩ መምህራን፡- 3. Teachers Teaching in Schools Established under Smaller City Administrations
1. የራሳቸው አስተዳደር ባላቸው አነስተኛ ከተሞች ውስጥ የሚያስተምሩ መምህራን በትምህርት ቤቶቻቸው አካባቢ በክልሉ መንግስት በጀትና በህዝብ ተሳትፎ ደረጃ በደረጃ በሚሰሩ የመኖሪያ መንደሮች በነፃ እንዲኖሩ ይደረጋል፡፡ 1. Teachers who happen to teach in smaller cities having their own administrations shall be made to reside freely in the residential villages to be constructed, step by step, in the surrounding area of their schools by the regional government’s budget and the participation of the public.
2. በዚህ አንቀጽ ንዑስ አንቀጽ (1) ስር የሰፈረው ድንጋጌ እንደተጠበቀ ሆኖ በመስኩ ያበረከቱት አገልግሎት 2 ዓመትና ከዚያ በላይ የሆነ መምህራን በራሳቸው ወጪ የግል መኖሪያ ቤት መስራት የፈለጉ እንደሆነ መመሪያ ቁጥር 28/2009 ዓ.ም በሚፈቅደው መሰረት ቁጥራቸው 14ና ከዚያ በላይ እየሆኑ በማህበር ተደራጅተው ቦታ ከጠየቁና ከቤቱ መስሪያ ጠቅላላ ዋጋ ውስጥ 20 ከመቶ የሚሆነውን ስለመቆጠባቸው ካረጋገጡ ቦታው በሊዝ መነሻ ዋጋ ይሰጣቸዋል፡፡ 2. Without prejudice to the provision laid down under Sub-Art. (1) of this Article hereof, where those teachers, whose service contributed in the field has lasted two years and above, so desire to construct private dwelling houses on their own expense and thereby request for land by having organized themselves in cooperatives numbering 14 and above as well as ascertained that they have managed to save 20% of the total price of the housing construction as permitted by the Directive No. 28/2017, such land shall be provided for them at the initial lease price.
3. በዚህ አንቀጽ ንዑስ አንቀጽ (2) ስር የተመለከተው ቢኖርም ጥያቄ አቅራቢ መምህራኑ ቁጥራቸው ከ14 በታች በሆነ ጊዜ በተናጠልም ቢሆን በሊዝ መነሻ ዋጋ የመኖሪያ ቤት መስሪያ ቦታ የማግኘት መብታቸው ይጠበቅላቸዋል፡፡ 3. Notwithstanding the provision laid down under Sub-Art. (2) of this Article hereof, where the number of those teachers submitting the request is below 14, their right to obtain land for the construction of dwelling houses at the initial lease price shall be respected even on an individual status.
4. ከዚህ በላይ በአንቀፅ 6 ንኡስ አንቀፆች (5)፣ (6)ና (7) ስር በንኡስ ማዘጋጃ-ቤቶች፣ ታዳጊ ከተሞችና የገጠር ቀበሌዎች ውሥጥ በተቋቋሙ ትምህርት ቤቶች የሚያስተምሩ መምህራንን በተመለከተ የሰፈሩት ድንጋጌዎች በአነስተኛ የከተማ አስተዳደሮች ውስጥ ለሚያስተምሩ አቻዎቻቸውም በተመሳሳይ ተፈፃሚ ይሆናሉ፡፡ 4. The provisions laid down under Sub-Arts. (5), (6) and (7) of Art. 6 herein above with regard to the teachers teaching in schools set up under sub-municipalities, emerging towns and rural Kebeles shall Mutatis mutandis apply to their counterparts teaching in smaller city administrations.
4. በመካከለኛ የከተማ አስተዳደሮች ውስጥ ባሉ ትምህርት ቤቶች ስለሚያስተምሩ መምህራን፡- 4. Teachers Teaching at Schools Located in the Medium City Administrations
1. በመካከለኛ የከተማ አስተዳደሮች ውስጥ በሚገኙ ትምህርት ቤቶች የሚያስተምሩ መምህራን በትምህርት ቤቶቻቸው አካባቢ በክልሉ መንግስት በጀትና በህዝብ ትብብር ደረጃ በደረጃ በሚገነቡ የመምህራን መኖሪያ መንደሮች ውስጥ ያሉ ቤቶችን በተመጣጣኝ ዋጋ ተከራይተው እንዲኖሩ ይደረጋል፡፡ 1. Teachers teaching at schools found in the Medium City Administrations shall be made to reside in those houses existing in the teachers’ residential villages to be constructed, step by step, by the regional government’s budget in collaboration with the public in the surrounding area of their schools, having accessed them with a reasonable amount of rent.
2. በዚህ አንቀጽ ንዑስ አንቀጽ (1) ስር የሰፈረው ድንጋጌ ቢኖርም በመስኩ ያበረከቱት አገልግሎት 2 ዓመትና ከዚያ በላይ የሆነ መምህራን በራሳቸው ወጪ የግል መኖሪያ ቤት መስራትን የመረጡ እንደሆነ መመሪያ ቁጥር 28/2009ዓ.ም በሚፈቅደው መሰረት ቁጥራቸው 14ና ከዚያ በላይ እየሆኑ በማህበር ተደራጅተውና ከቤቱ መስሪያ ጠቅላላ ዋጋ ውስጥ 20 ከመቶ የሚሆነውን ስለመቆጠባቸው አረጋግጠው የጠየቁት ቦታ በከተማው የሊዝ መነሻ ዋጋ ሊሰጣቸው ይችላል፡፡ 2. Notwithstanding the provision laid down under Sub-Art. (1) of this Article hereof, where those teachers, whose service contributed in the field has lasted two years and above, prefer to construct private dwelling houses on their own expense and thereby request land by having organized themselves in cooperatives numbering 14 and above in accordance with the Directive No. 28/2017 as well as ascertained that they have managed to save 20% of the total price of the housing construction, such land which they have requested shall be provided to them at the city’s initial lease price.
3. ከዚህ በላይ የሰፈረው ንዑስ አንቀጽ (2) ቢኖርም የጥያቄ አቅራቢዎቹ ቁጥር ከ14 በታች በሆነ ጊዜ መምህራኑ በተናጠልም ቢሆን የመኖሪያ ቤት መስሪያ ቦታ በሊዝ መነሻ ዋጋ ሊሰጣቸው ይችላል፡፡ 3. Notwithstanding the provision of Sub-Art. (2) laid down herein above, where the number of teachers submitting the request is below 14, they may be provided with the land for the construction of dwelling houses against the city’s initial lease price, even on an individual basis.
4. ይህ የማይቻልበት ሁኔታ በተፈጠረ ጊዜ የከተማ አስተዳደሩ ለከተማው ነዋሪዎች ከሚገነባቸውና ለክልሉ መንግስት ሰራተኞች ከሚሰጣቸው አፓርተማዎች ወይም የጋራ መኖሪያ ቤቶች ውስጥ 20 ከመቶ በሚሆነው ድርሻ እኩል የሚጠቀሙ መሆናቸው ሳይቀር መምህራን 10 ከመቶ ተጨማሪ እድል ተሰጥቷቸው እርስ በርሳቸው ለብቻ ይወዳደራሉ፡፡ 4. Where such an impossible condition has been encountered, teachers shall, without regard to the fact that they equally benefit from the 20% share out of the apartments or condominiums to be constructed by the city administration for the urban dwellers and allocated for the regional civil servants, solely compete amongst themselves, having been given ten percent additional opportunity.
5. ከዚህ በላይ በአንቀፅ 6 ንኡስ አንቀፆች (5)፣ (6)ና (7) ስር በንኡስ ማዘጋጃ-ቤቶች፣ ታዳጊ ከተሞችና የገጠር ቀበሌዎች ውሥጥ በተቋቋሙ ትምህርት ቤቶች የሚያስተምሩ መምህራንን በተመለከተ የሰፈሩት ድንጋጌዎች በመካከለኛ የከተማ አስተዳደሮች ውስጥ ለሚያስተምሩ አቻዎቻቸውም በተመሳሳይ ተፈፃሚ ይሆናሉ፡፡ 5. The provisions laid down under Sub-Arts. (5), (6) and (7) of Art. 6 herein above with regard to those teachers teaching at schools set up under sub-municipalities, emerging towns and rural Kebeles shall mutatis mutandis apply to their counter-parts teaching in the medium city administrations.
5. በሜትሮፖሊታን ከተሞች ስለሚያስተምሩ መምህራን፡- 5. Teachers Teaching in the Metropolitan Cities
1. በሜትሮፖሊታን ከተሞች በሚገኙ ትምህርት ቤቶች ውስጥ የሚያስተምሩ መምህራን የክልሉን መንግስት አቅም ባገናዘበ ሁኔታ የጋራ መኖሪያ መንደር ደረጃ በደረጃ ከተገነባ በኋላ ቤቱ በተመጣጣኝ ኪራይ እንዲሰጣቸው ይደረጋል፡፡ 1. Following the construction, step by step, of condominiums by taking the capacity of the regional government into consideration, the houses therein shall be provided for teachers who happen to teach at the schools found in the metropolitan cities with a reasonable amount of rent.
2. በዚህ አንቀጽ ንዑስ አንቀጽ (1) ስር የሰፈረው ድንጋጌ እንደተጠበቀ ሆኖ በመስኩ ያበረከቱት አገልግሎት 2 ዓመትና ከዚያ በላይ የሆነ መምህራን በራሳቸው ወጪ የግል መኖሪያ ቤት መስራት የፈለጉ እንደሆነ መመሪያ ቁጥር 28/2009 ዓ.ም በሚፈቅደው መሰረት ቁጥራቸው 14ና ከዚያ በላይ እየሆኑ በማህበር ተደራጅተው ከጠየቁና ከቤቱ መስሪያ ጠቅላላ ዋጋ ውስጥ 10 ከመቶ የሚሆነውን ስለመቆጠባቸው ካረጋገጡ ቦታው በከተማው ሊዝ መነሻ ዋጋ ይሰጣቸዋል፡፡ 2. Without prejudice to the provision laid down under Sub-Art. (1) of this Article hereof, where those teachers, whose service contributed in the field has lasted two years and above, so desire to construct private dwelling houses on their own expense and thereby request for land by having organized themselves in cooperatives numbering 14 and above in accordance with the Directive No. 28/2017 as well as ascertain that they have managed to save 10% of the total price of the housing construction, such land shall be provided to them against the city’s initial lease price.
1. በዚህ አንቀጽ ንዑስ አንቀጽ (2) ስር የተመለከተው ቢኖርም ጥያቄ አቅራቢ መምህራኑ ቁጥራቸው ከ14 በታች በሆነ ጊዜ በተናጠልም ቢሆን በከተማው ሊዝ መነሻ ዋጋ የመኖሪያ ቤት መስሪያ ቦታ የማግኘት መብታቸው ይጠበቅላቸዋል፡፡ 1. Notwithstanding the provision indicated under Sub-Art. (2) of this Article hereof, where the number of teachers submitting the request is below 14, their right to obtain land for the constructionn of dwelling houses against the city’s initial lease price shall be respected, even on an individual status.
2. በሜትሮፖሊታን ከተማ አስተዳደሮች ስር በሚጠቃለሉ የገጠር አካባቢዎች በተቋቋሙ ትምህርት ቤቶች ውስጥ የሚያስተምሩ መምህራን ጥያቄ አግባብ ያላቸውን የዚህን ደንብ አንቀጽ 6 ድንጋጌዎች መሰረት በማድረግ ለማስተማር በተመደቡባቸው የገጠር ቀበሌ ማዕከላት በኩል ይስተናገዳል፡፡ 2. The request of those teachers serving at the schools set up in the rural areas embraced in the metropolitan city administrations shall be addressed on the part of the rural Kebele centers, wherein they have been assigned to teach, in accordance with the pertinent provisions of Art. 6 of this Regulation hereof.
1. ከዚህ በላይ በአንቀፅ 6 ንኡስ አንቀፆች (5)፣ (6)ና (7) ስር በንኡስ ማዘጋጃ-ቤቶች፣ ታዳጊ ከተሞችና የገጠር ቀበሌዎች ውሥጥ በተቋቋሙ ትምህርት ቤቶች የሚያስተምሩ መምህራንን በተመለከተ የሰፈሩት ድንጋጌዎች አግባብነታቸው እየታየ በሜትሮፖሊታን ከተሞች ውስጥ ለሚያስተምሩ ኣቻዎቻቸውም በተመሳሳይ ተፈፃሚ ይሆናሉ፡፡ 1. The provisions laid down under Sub-Arts. (5), (6) and (7) of Art. 6 herein above shall, with regard to the teachers serving at the schools set up under sub-municipalities, emerging towns and rural Kebeles, shall, mutatis mutandis, apply to their counterparts teaching in metropolitan city administrations, having due regard to their appropriateness.
