Care not Cuffs - Kelly Hartigan

Care not Cuffs - Kelly Hartigan This page has been set up so we can share the ongoing legal cases with Lancashire Police. A real perspective from the family.

The struggle families face when the state malfunctions and rather than keep you safe, it does the opposite.

Big news

Yesterday we had a meeting with the IOPC Director General Rachel Watson & Regional Director Richard Ford.

Since Kelly’s passing the IOPC have been investigating, sometimes good, sometimes horrifically bad. Yesterday they accepted that fact and personally apologised for multiple catastrophic failures.

Kelly is now the first victim to receive a Victim’s Right to Review. The family and our legal team have relentlessly pushed for truth & justice. We can now confirm that the IOPC offer a VRR in all instances, and this will become law early in 2025.

Kelly’s legacy will live on forever and any family in the future will have access to a Review of an IOPC decision. The IOPC have a new management structure and a new direction, we’re confident they are moving in the right direction.

Special thanks to Carolynn Galway pictured and our wider legal team. Bhatt Murphy, Doughty Street Chambers & Inquest.org.

SoulsINQUEST - Kelly Hartigan 🙏

We were invited to take part in and help launch SoulsINQUEST. An exhibition highlighting with photography, text and archive as a lens onto state violence, death, grief and resistance. The exhibition is an embodiment of family resistance that refuses to be silenced, misrepresented or forgotten. A collaboration between bereaved families, Sarah Booker and INQUEST, it is a powerful act of defiance in response to decades of injustice.

The latest update on the never ending journey seeking justice for Kelly.

This could’ve ended a long time ago if people just told the truth and owned up to their mistakes.

IOPC Press Release:

‘We have concluded our investigation into a complaint regarding some of the evidence heard from police witnesses during the inquest into the death of Kelly Hartigan-Burns.

We reviewed a significant amount of material relating to information provided during both the IPCC investigation into the death, as well as the subsequent inquest. We also interviewed an officer under criminal caution.

On completion of our investigation, we determined the officer had a case to answer for gross misconduct in relation to an allegation they may have provided inaccurate statements.
It will be for an independently-chaired panel to consider the evidence at disciplinary proceedings, which will be arranged by the force.

We are also in the process of referring the matter to the Crown Prosecution Service (CPS) to consider possible charges. This follows a Victims’ Right to Review of our initial decision that we would not be making a referral.

A referral to the CPS does not necessarily mean that criminal charges will be authorised. It will now be for prosecutors to determine whether any charges should follow.

Our thoughts remain with Kelly’s family, as well as all those affected by her death.’

A lot of people are starting to realise that you can be the victim of a massive injustice at the hands of the state or ‘Independent’ public bodies and nothing seems to be getting done about it. Hardly anyone is held to account……

Welcome to our world. Six years of fighting so far. We will never stop.

The Post Office Horizon inquiry restarts today, following renewed interested in the scandal following the airing of the ITV drama Mr Bates vs The Post Office.

After a wait of SIX years for Kelly’s Inquest to be heard.

Since then we are still waiting for phase 2 outcome. It was meant to take 6 to 9mths. Should have finished Nov 2022.

Promise after promise still not had the decision.

So many more recent cases heard and completed. Why is Kellys case always left and left as if she didnt matter. How much are they paid to make decisions, I hope one day they endure the inhuman torture they put innocent bereaved families through!

We said we will never give up until everyone concerned with my sisters passing faces justice.

I’m so pleased to share this wonderful video documenting the SoulsINQUEST exhibition opening at 198 Contemporary Arts & Learning. It was made by Lucy’s friend, Kat, who spent the whole day filming on launch day and has created a moving short film, which beautifully conveys the impact of the exhibition and the energy in the room on that launch night. The video is testament to all of the love and commitment that everyone put into this project

Public and private bodies have a duty to keep us safe from harm and protect our lives, but every year hundreds of people die preventable deaths in state custody or care. These include deaths of people in police and prison custody, mental health settings and following disasters including at Grenfell....
