“My child wants to learn… they just can’t face school.”

This is something we hear regularly during Education Consultancy appointments at Live to Learn Integrated Assessments and Education Consultancy.

Many families come to us when their child is experiencing EBSNA (Emotionally Based School Non-Attendance) and the situation has become overwhelming.

The uniform is ready.
The bag is packed.
But your child is in tears, unable to leave the house.

For many children, this isn’t defiance or poor behaviour. EBSNA happens when a child is too emotionally distressed to attend school, often linked to anxiety, sensory overwhelm, bullying, or unmet needs within the school environment.

For these children, school can trigger a genuine fight, flight, or shutdown response.

Parents often feel stuck between:
• Pressure from school around attendance
• A child whose wellbeing is deteriorating
• Not knowing what support or rights they have

📚 It’s important to know that children still have a legal right to education even when they cannot attend school.

Under Section 19 of the Education Act 1996, Local Authorities must provide suitable education for children who cannot attend school because of illness or other reasons.

Schools also have duties under the Equality Act 2010 to make reasonable adjustments for disabled pupils, including many neurodivergent children.

Sometimes the traditional school environment simply isn’t the right setting for a period of time (or forever), and children need a different approach to rebuild confidence and reconnect with learning.

During our Education Consultancy appointments, we help families to:

✔ Understand what schools and Local Authorities are legally required to do
✔ Explore appropriate education options
✔ Create a clear plan that protects both wellbeing and access to education

Meet Victoria — Specialist Mental Health Practitioner & ADOS-2 Assessor

Victoria works alongside neurodivergent young people to help them feel supported, understood and confident in who they are. This is work she has been passionate about for many years — and something she truly loves.

Victoria is neurodivergent herself, as is her wonderful son, giving her both professional expertise and meaningful lived experience. Her son describes her as his “safe person” who helps him feel calm (although he also says her singing is really bad!).

Outside of work, Victoria enjoys swimming, reading, listening to music, drinking tea and relaxing at home with a cosy blanket. Her safe people are her son and two close friends who mean the world to her. If she had a magic wand, she would make sure everyone was kind — and book a peaceful holiday with a swimming pool.

Victoria’s calm, honest and relaxed approach helps young people feel at ease, especially if they are feeling nervous about assessment.

At Live to Learn Integrated Assessments, Victoria meets with young people who would like to better understand their neurotype. During the ADOS-2 assessment, they spend around an hour together completing supportive activities and gentle conversation, giving young people space to share what life is like for them in a safe, respectful environment.

📌 **SEND White Paper ‘Leaks’ — Let’s Pause Before We Panic**

There’s been a lot of noise recently about *‘leaks’* from the upcoming SEND White Paper. I completely understand why this is triggering anxiety — families and professionals have worked tirelessly to secure support for children and young people with SEND.

But it’s important to remember: **nothing has officially changed.**

Leaks are not law. They are not statutory guidance. They are not confirmed policy. Until the government formally publishes the SEND White Paper, we simply do not know what the final proposals will be — or how they will be implemented.

Right now, jumping to conclusions only fuels uncertainty and stress.

🧠 From a wellbeing perspective, this is a moment to **pause**.
Pause before assuming the worst.
Pause before sharing unverified claims.
Pause before letting fear take over.

There will **always** be ways to advocate for and protect our children’s rights. The legal framework does not disappear overnight. Families, professionals, and communities have consistently found ways to challenge, campaign, and push for what children need — and that will not change.

✨ What we can do now:
• Continue supporting children within the current system
• Stay informed from credible, official sources
• Hold space for concern without amplifying panic
• Look after our own wellbeing so we can continue to advocate effectively

When the SEND White Paper is formally released, that is the time to analyse it carefully and respond thoughtfully.

Until then, let’s stay grounded, stay informed, and stay united in our commitment to children and young people with SEND.

**15th February – A Difficult Deadline for Many SEN Families**

For parents and carers of children with EHCPs, 15th February can be an incredibly stressful date; It’s the statutory deadline for Local Authorities to issue a final EHCP for phase transfer (for example, moving from primary to secondary school).

By today, families should have certainty about where their child is going in September 2026.

But for many, that certainty hasn’t come.

If your Local Authority has:

🔹 Only named a “type” of setting (e.g. “mainstream secondary” or “special school”)
This is not lawful. Section I of an EHCP must name a *specific school or setting*. Naming a type alone is not compliant with the SEND Code of Practice. You can formally request that a specific placement is named.

🔹 Not issued a final EHCP by the deadline
The LA is in breach of its statutory duty. While this doesn’t automatically secure a placement, you can:

* Write to the LA requesting urgent confirmation of when the final EHCP will be issued
* Escalate via the LA’s complaints procedure
* Seek advice about possible legal action (including pre-action protocol for judicial review in serious delay cases)

🔹 Named a school you disagree with
Once a final EHCP is issued, you have the right to appeal to the SEND Tribunal. The appeal window is time-limited, so it’s important to seek advice promptly.

Meet Pennie 💛
Occupational Therapist

Pennie is an experienced Occupational Therapist with over 15 years of clinical practice across mental health and specialist children’s services. She has a particular passion for supporting children who have experienced early years trauma and those with complex emotional and sensory needs.

Her work is grounded in a neuro-inclusive, compassionate approach that recognises and respects the many different ways children experience the world. Pennie has undertaken additional training in Sensory Attachment Intervention and is currently completing specialist training in Sensory Integration, deepening her understanding of the science behind sensory processing differences.

Pennie believes that every child can flourish when given the right understanding, environment and support. She works closely with families to help make everyday life feel calmer, more manageable and more connected.
