Spiking Statistics – Scotland (2025)
Drink spiking remains a significant concern, with new data highlighting both the scale of the problem and the level of underreporting.
Key Findings
760 incidents were officially recorded by Police Scotland between 2020–2025.
Based on Drinkaware’s estimate that only 1 in 10 cases are reported, the true number may exceed 7,600 incidents.
In 2025, 1.5% of adults in Scotland—around 67,000 people—reported being spiked in the past year.
Of the recorded cases:
682 were classified as “drugging”.
78 involved substances used for sexual purposes.
Drinkaware Monitor 2025:
2% of women and 1.5% of men reported being spiked in the last year.
A wider study found 11.3% of adults have been spiked at some point in their lives (13% of women, 9% of men).
A BBC investigation revealed no convictions recorded in Scotland in the past five years, despite dozens of reports—highlighting challenges in evidence and prosecution.

Drink spiking is significantly underreported due to fear, stigma, or uncertainty.
Spiking includes:
Adding illegal drugs (e.g., GHB, Ketamine)
Adding prescription medication
Adding extra alcohol
Needle/injection spiking

Legal Overview – Drink Spiking in the UK (as of Nov 2025)
Although there is currently no single offence labelled “drink spiking,” multiple serious laws are used to prosecute offenders.
Existing Legislation
Offences Against the Person Act 1861 (OAPA)
Section 24: Administering a noxious substance with intent to injure, aggrieve, or annoy
Max penalty: 5 years
Section 23: Administering poison to endanger life or cause GBH
Max penalty: 10 years
Sexual Offences Act 2003 (Section 61)
Administering a substance to enable sexual activity without consent
Max penalty: 10 years
New Legislation Incoming
The UK Government has proposed a dedicated “administering a harmful substance” offence within the Crime and Policing Bill.
This new law aims to:
Modernise outdated legislation:
Create one clear offence for all forms of spiking
Improve police reporting and data collection
Strengthen public understanding and encourage victims to come forward
This offence covers:
Drug spiking
Alcohol spiking
Prescription drug misuse
Needle/injection spiking
If You Believe You or Someone Else Has Been Spiked
1. Seek medical help immediately – call 999 or NHS 111.
2. Report to police as soon as possible – drugs may leave the body within 12–72 hours.
3. Preserve evidence (glass, bottle, can).
4. You can also report anonymously via Crimestoppers.
Remember: The victim is never at fault. Responsibility lies 100% with the perpetrator.
