Mental wellbeing in the legal profession matters.
LawCare’s Life in the Law 2025 report found that nearly 60% of legal professionals experience poor mental wellbeing, with long hours and workplace pressures continuing to impact individuals across the sector.

At Medical Solicitors, we have created a workplace culture that isn’t just about billing targets and working around the clock, one where wellbeing is valued just as highly as professional success.

We’re trying to do things a little differently as, at the end of the day, our lawyers are people with their own families and personal lives.

At our firm, we support mental health by:
🔹 Promoting work-life balance
🔹 Encouraging open conversations
🔹 Offering access to CPD opportunities
🔹 Supporting one another without judgment

We are also proud to be part of the Mind Business Wellbeing Charter, which supports our ongoing work to create a healthy and supportive workplace culture.

This Mental Health Awareness Week, we’re
encouraging our teams to check in with each other and take positive breaks. The Hull team are having a walk and talk around the marina, the York team are organising a wellbeing lunch, and our Sheffield team have planned a get-together in the office with some tasty food.

But wellbeing shouldn’t only be a conversation for one week of the year. Looking after ourselves and each other is something we should all prioritise every day.

Did you know you have a legal right to access your medical records in the UK?

That includes GP notes, hospital records, test results and treatment history.

Obtaining a copy of your medical records is called a Subject Access Request (SAR). You usually have to contact each NHS provider individually and they have one month to action your request.

If something in your records is inaccurate, you can ask for it to be corrected.

In medical negligence claims, medical records are often key evidence in understanding what happened.

With your authority, we can request medical records directly on your behalf as part of investigating a potential claim. Our team will then use your records to identify whether your care fell below an acceptable standard.

It’s been a busy week at Medical Solicitors! Yesterday, Caroline, Tash and Zarqaa were in Birmingham for the SCIL conference and exhibition event.

A great day of learning and networking, with talks about everything from costs, secondary trauma and spinal injury litigation.

We particularly enjoyed the talk by Dr Idz, an NHS doctor with a masters degree in nutrition, who spoke about how social media is fuelling a rise in misinformation about nutritional health - and how he’s trying to debunk those myths.

Also good to see our friends at 7BR Chambers and Bush & Co.

We’re proud to announce that Sophie, our wonderful cashiers and operations assistant, has passed the AAT Level 2 Certificate in Bookkeeping after taking the second exam earlier this week📚🎉

Sophie has put in so much hard work and study time over this last year, so it’s no surprise that she has passed the full course with flying colours.

Today is World Maternal Mental Health Day.
So, did you know that 1 in 5 women will experience perinatal mental ill-health including depression, anxiety, and postpartum PTSD.

If you're struggling either during or after pregnancy, don't just dismiss it as the 'baby blues'.
Whether its your first or fourth baby - your feelings are valid. Help is available and you are not alone💕

Anyone can experience a maternal mental health problem.
However, birth trauma or having a child with a serious medical condition due to birth injuries are things that can increase the likelihood.

Experiencing a mixture of emotions before or after pregnancy is completely normal, but if you feel like it is starting to affect your wellbeing then do seek help.
The Maternal Mental Health Alliance has lots of guidance here https://maternalmentalhealthalliance.org/about-maternal-mental-health/support-mums-and-families/

Anything is possible when you have the right people there to support you...

In most cases, it will be the primary victim of medical negligence who makes a claim for compensation. However, there are certain times when a 'Litigation Friend' will need to be appointed to act on the claimant’s behalf.

For , we look at what a litigation friend is, who can become one, what the role involves, and how it affects a claim.

The two situations where a Litigation Friend is necessary are:
🔹 If the Claimant is under 18.
The litigation friend will usually be a parent.

🔹 If the Claimant is a 'protected party' i.e., they lack mental capacity, usually due to disability, mental illness or injury.
In this case, the litigation friend could be a spouse, parent, child, sibling, close friend, carer, solicitor, or someone who has Lasting Power of Attorney for that person.

Generally, the claim proceeds in the same way, with the litigation friend stepping into the shoes of a claimant. They sign documents, attend meetings, and make decisions about a claim.

The main difference is that any settlement agreed must be approved by the Court which provides a measure of extra protection to the Claimant.

Yesterday, two of our trainee solicitors Zarqaa and Joe were in Manchester for the 12 King's Bench Walk clin neg and PI conference.

A very insightful afternoon with talks about interim payments, causation and proof, and supporting clients at Inquest.

Events like this are an opportunity to learn beyond the office walls, building on their training by gaining real-world insights from industry experts and bringing valuable knowledge back to better support our clients.

A well-deserved congratulations to Lyndsey Taylor from our York office who has secured compensation for our client whose partner died following unnecessary pancreatic fine needle aspiration.

While rare, fine needle aspiration has known risks of excessive bleeding, infection, acute pancreatitis, and a hole in the small intestine.
The lady sadly died from complications with the procedure.

There was a lack of appropriate consent before the endoscopic ultrasound guided procedure and there was no valid clinical reason to perform the procedure at all.

Her partner brought a medical negligence claim on behalf of her estate and Lyndsey negotiated a settlement of £60,000.

The outcome not only provides financial support for the client’s future care, but also delivers a sense of closure for our client.

In medical negligence claims, the burden of proof sits with the claimant.

That means it’s not enough to say something went wrong - you need evidence to show that care fell below a reasonable standard and caused harm.

If you’re considering legal action, here’s what evidence can help support your claim.

The more robust your evidence, the stronger your position.

One of the most common worries people have when contacting our medical negligence team is: “I missed the three-year time limit. Does that mean I can’t make a claim?”

The honest answer is: not necessarily.
There are several important exceptions, nuances and discretionary powers that mean your case may still be investigated even if the limitation period has passed or is fast approaching.

And we're certainly not a law firm that shies away from 'late' cases.
If your case deserves investigation, we will look at it, even if another firm has told you it’s out of time.

In our latest blog, we look at how the time limit works, when you may still have options, and provide real examples cases we investigated that appeared to be out of time.
