Where the patient's primary need, is one of health, which covers both physical and mental health, then the responsibility is that of the NHS, even when the individual has been placed in the home by the local authority. Anyone who was in a care home between 1 April 2004 and 31 March 2011 may be entitled to reclaim the full cost of their private care home fees if their primary care need was health related.
