1. What is Personal Insolvency?
📌 Personal Insolvency is when you are unable to pay your debts as they fall due.
2. What is a PIP?
📌 A PIP is a Personal Insolvency Practitioner. They liaise with your creditors in relation to a Personal Insolvency Arrangement(PIA) or Debt Settlement Arrangement(DSA).
3. What is a Protective Certificate (PC)?
📌This is an order issued by the court which offers the debtor and their assets protection from legal proceedings by creditors. A PC lasts 70 days. This can be extended if required.
4. Do I have to go to court?
📌 No you do not have to attend court at all during the Insolvency process.
5. How long does an arrangement last?
📌 Arrangements can be as little as 6 months or some may last for 6 years, each case is different.

Have you took the time lately to have a financial health check?
Isn't this a great time to have one if you haven't already done so!! Here is some advice we have for you.
Take an hour out of your day and sit down and go through all your paperwork. Starting with your Bank Statements take note of all your expenses. Make two lists essential and non essential. Do a total of your months expenses on each column. On your non essential column how much does your figure come to? What can you do differently with your money next month that puts you and your family financially in a better place? Plan ahead with next months salary. allocate money per week on essential bills and think before you spend!!
Our second bit of advice we have for you is to shop around. Take the time to look at your utility bills and see can you get a better deal elsewhere? Phone around to different companies and compare the prices. Like wise take out your life policies and home insurance policies, it might be easier to stay with the company you are with, but could you get a better quote elsewhere. Small Company Administrative Rescue Process (SCARP) was passed on 13 July 2021 by the Oireachtas.
The main objective of SCARP is to save a company and to save peoples jobs in the process.
Briefly to explain, SCARP is an alternative solution to that of Examinership, that includes some aspects of Personal Insolvency. The Government felt that Examinership process was too costly for small businesses. This alternative is a brand new process specifically for small/micro businesses. The business must be unable to pay debts as they fall due and they must not be in liquidation in order to be eligible to try this rescue plan for their business.
The company will then choose a Personal Insolvency Practitioner to act as a Process Advisor who will gather your information to see if your company can potentially survive, if they feel the company can survive they will prepare your rescue plan. R Hendy & Co have two Process Advisors that will gladly assist in getting your small business back on track.

Christmas is just around the corner, here are some tips we have for you to manage money over the festive season 🎅
1. Plan your budget - know your income and monthly expenses. Any additional money left over can be used towards Christmas spending. Mortgage payments are your number 1 priority!
2. Avoid taking out new loans and going over your credit card limit or overdraft to cover the cost of Christmas. Buy what you can afford! 'It's the thought that counts'.
3. Secret Santa - Where possible try suggest this with your family or group of friends, this is a great way of keeping costs low. It also takes the stress out of buying for everyone.
4. Set up a Christmas Savings Account for 2022 - the money you save cannot be touched throughout the year it can only be taken out in November or December of that year so if it's not showing in your current account it can't be spent.
5. Extra Shifts at work - if the option is available in your employment ask for additional shifts to cover additional Christmas expenses. Having this cushion could help you go into the new year with no debts.
6. Keep receipts and keep a list of what you bought and spent this Christmas and next year you could cut costs even more by making changes where you can to this years Christmas spending. Think Ahead!!

Steps to Dealing with Financial Stress and looking after your mental health.
1. Talk to someone - many may feel it's a taboo subject, but you should not feel ashamed or embarrassed. Bottling these things up will only make your financial stress worse. The person you confide in doesn't have to offer financial help, it is just someone you can talk to without judgment or criticism. ie. family member or friend.
2. Seek Professional Advice - Discuss your financial worries with a Personal Insolvency Practitioner. R Hendy & Co can assess your debts to see if you are eligible for a Debt Settlement Arrangement or Personal Insolvency Arrangement - free and non judgmental advice.
3. Create a monthly budget plan - Know your income and know your expenses. Prioritise! Essentials before luxuries. ie. food and utility bills. Make a payment towards your mortgage and if possible try to make small repayments to your other loans, let it be €5 per week, something is better than nothing!
4. Look after yourself!! - Exercise daily, ensure you get enough sleep, eat healthy and be grateful for the good things happening in your life! Let the positives outweigh the negatives that are happening right now.
