5G Mast Bluebell Update (22nd October ‘24) … VERY IMPORTANT UPDATE … Mast Installation, Judicial Review & Public Meeting.

As you may know from a previous post, An Bord Pleanála once again granted Cignal (Vodafone) permission to place a 5G Mast on our much loved green at the entrance to Bluebell. The only option left for us to block it, was to once again seek a Judicial Review in the High Court. In order to proceed with this, we needed someone to take the action on behalf of our community and a legal team.

Bluebell is very fortunate to have the dedication, expertise and support of our former elected councillor Sophie Nicoullaud (Right To Change) who has volunteered to take the action on our behalf once again. I am also very pleased to say that the legal team who took on the last judicial review have kindly agreed to do the same again.

The process of seeking the Judicial Review has started. Thank you Sophie for going above and beyond in helping us—you’ve truly made a difference, and we’re fortunate to have someone as dedicated as you on our side.

WE ALL NEED TO HELP as this is about our community and we need to come together to fight this campaign for our green. This is about seeking justice for Bluebell.

A PUBLIC MEETING is going to happen in the next week or two and we will let you know the details shortly. This will help us to plan the campaign and look at fundraising, protests, lobbying and support.

😡 Very disappointing and unwelcome news re: the 5G Mast on the our public green at the entrance to Bluebell.

As you know, many of us in Bluebell campaigned against the siting of the 5G Mast on our loved green and we went to the High Court last year for a Judicial Review. Our then councillor, Sophie Nicoullaud and our legal team were in the High Court last year and the judge wisely accepted that we have a substantial enough case and that DCC and Cignal couldn’t go ahead with the plan for their 5G Mast on our green in Bluebell at that time.

An Bord Pleanála, have reviewed the application since then and have decided to grant a licence to build the 5G Mast. I am attaching their recent correspondence to me in relation to same. I am shocked and have been linking in with the legal team, Sophie and others to see where we go and examining the Board’s Inspectors report.

We need to group together again to look at options that I will outline further on.

The AGM for the Bluebell Residents Association takes place on Tuesday 24th September at 7pm in the Bluebell Community Centre. I will bring the issue up for discussion and I would encourage as many of you who are concerned about the 5G Mast to attend. We could discuss further after the AGM.

Options/Actions include:

- Demanding that Dublin City Council (DCC) withdraw their offer to give away part of our green to a private telecommunications company.
- Remind DCC that they need to protect our green and amenities.
- Ask our elected public representatives to stand up and support our community on this issue.
- Protest at the stores of Vodafone.
- Look to see if another Judicial Review is a viable option.

Bluebell telecom mast update and how community activists make a difference. We have won our case!!!!

Judicial Review of the decision of An Bord Pleanála granting a telecommunications infrastructure licence under Section 254 of the Planning and Development Act 2000 to Cignal Infrastructure for the er****on of a mobile telecommunications mast at the Old Naas Road, Bluebell Dublin 12

Active residents in Bluebell and myself where standing at the green in Bluebell on a sunny day in summer 2022 to oppose the installation of a telecom mast and its cabinet.

The company Cignal Infrastructure Ltd applied in Spring 2022 to DCC for a section 254 licence street furniture. DCC granted the licence. The mast was to be used by Vodafone and its customers.

An Bord Pleanála has rejected all objections to the project. Eoin Brady with Dublin Law firm FP Logue LLP had lodging the judicial review to the High Court on my behalf with the support of the community.

We have learned last Friday that An Bord Pleanála is conceding the case. We are awaiting the reasons for this decision.

So in plain English it means that the section 254 licence is quashed!

Using section 254 licence to erect telecom mast is undemocratic. Our local authorities who give licence to private companies to erect telecom mast on public land for free ( just a minuscule fee applies) is wrong.

I am delighted for the residents of Bluebell, for residents on Navan Road that this precious public green space so well maintained by the community will remain as it is.

5G Mast Bluebell Update… so far so good! 🤞👏 …good news from the High Court today.

Well done to our Councillor Sophie NiCoullaud and our legal team who were in the High Court today on our behalf. The judge wisely accepted that we have a substantial enough case and that DCC and Cignal can’t go ahead with the plan for their 5G Mast on our green in Bluebell for the time being.

The judge had granted us leave to apply for the Judicial Review as we have strong enough grounds to proceed.

Meanwhile, yesterday Paul Hyde of An Bord Pleanála appeared before the District Court on nine counts of failing to comply with planning laws. (Article attached in comments section below). We highlighted our concerns about the validity and integrity of the decisions of Dublin City Council and An Bord Pleanála.

We still have a journey to go and fingers crossed justice for Bluebell will prevail. Thanks to those who have donated to the campaign so far. We still need to fundraise more and I will attach the GoFundMe & Revolut links in the comments section below.

5G Mast Judicial Review Update… I wish to confirm that the proceedings have been issued today and opened before Mr Justice Charles Meenan, who deemed them opened and adjourned them to next Monday.

The proceedings challenge a decision of An Bord Pleanála granting a telecommunications infrastructure licence to Cignal Infrastructure in Bluebell, Dublin 12.

Well done Bluebell and to our dedicated local councillor Sophie Nicoullaud Right To Change Dublin Councillor who is the applicant on our behalf and has given so much of her time supporting us. Thanks also to our legal team and in particular Eoin Brady who have done a huge amount of work going through the files relating to this 5G Mast proposed for our community green space.

It is very satisfying knowing that we in Bluebell are doing everything we can to protect our green, our trees and our community from a planning process that is dubious and flawed.

Fingers crossed we will be successful in our Judicial Review. We can be proud of our journey thus far.

5G Mast Update … Legal Update & Funding Update!

Cllr Sophie NiCoullaud and I had a very good meeting today with our Barrister and Solicitor in relation to the Judicial Review that we are planning to lodge next week.

Our legal team have identified so many strong grounds that would give us confidence going forward that we may be successful with the Judicial Review.

The Council and An Bord Pleanála have failed in their responsibility to our community of Bluebell in this matter by ignoring their own planning guidelines, development plan and proper consideration of the impact of the 5G Mast on our much loved green space. So much was ignored and rubber stamped by officials who have no interest in our community. In fact, guidelines state that these 5G Masts should only be considered in residential areas if there is no adjacent industrial or commercial areas that would be more appropriate.

This is wrong. We have been treated unfairly. We deserve better. Enough is enough.

I have to say thank you to those in Dublin City Council e.g. the planning department, the public lighting department who spoke up and said this was the wrong location and should not go ahead. Their concerns were ignored.

In relation to fundraising, we have had three donations totally €30. Our target is €1000. I will attach the Revolut link again in the comments below if you wish to donate. We will have to organise fundraisers soon. We will keep you posted.

Fundraising campaign for Judicial Review (legal challenge) and campaign to stop the 5G Mast at the entrance to Bluebell.

Several people have contacted asking how they can donate to help fund our Judicial Review and campaign. We will try set up a ‘GoFundMe’ account but in the mean time, we can accept donations through Revolut (see my Revolut details in comments below). We will acknowledge and confirm your donation with you. We will also update as do how much we have collected. Our Initial target is €1000. We will also plan other events to fundraise.

Cllr Sophie Nicoullaud and I are meeting our legal team (barrister and solicitor) next week in advance of the application for a Judicial Review.

The decision made by a Dublin City Council official to rubber stamp the granting of a Licence for the Mast against the advice of many of their own departments (including the Planning Department and Public Lighting Department) is unjust, dubious and wrong. This requires serious scrutiny. Likewise the way our appeal was handled by An Bord Pleanála raises more concerns.

Bluebell deserves and demands better from Dublin City Council. Our community and especially through the Bluebell Environment Group have taken pride in the landscaping and their work at this entrance to Bluebell. Our green spaces are special and limited. They should not be given over for free to private telecommunication companies at the expense of our community and our health.
