In India, the use of ultrasound machines is regulated under the Pre-Conception and Pre-Natal Diagnostic Techniques (Prohibition of S*x Selection) Act, 1994 (PCPNDT Act). This law was enacted to prevent the misuse of ultrasound technology for s*x determination and female foeticide. Below are the key regulations:
1. Registration of Ultrasound Clinics & Machines
Every ultrasound clinic, diagnostic center, or hospital using ultrasound machines must be registered under the PCPNDT Act.
A registration certificate must be obtained from the Appropriate Authority (State or District Health Authorities).
The registration must be renewed every five years.
2. Qualification & Training Requirements
Only qualified doctors and radiologists with approved medical degrees (like MBBS with a radiology diploma or MD in Radiology) can operate an ultrasound machine.
Training is required for doctors using ultrasound for obstetric and gynecological purposes.
3. Record Keeping & Form Submission
Detailed records of every ultrasound performed must be maintained, including patient details and reasons for the scan.
Form F (a mandatory declaration form) must be filled and submitted to the authorities for every pregnancy-related scan.
All records must be kept for a minimum of five years and must be available for inspection.
4. Prohibition of S*x Determination
It is illegal to use ultrasound for determining the s*x of a fetus.
No person, including doctors and technicians, can communicate the s*x of a fetus to anyone.
Violations can lead to imprisonment (up to 5 years) and fines (up to ₹1 lakh).
5. Display of Legal Notices
Clinics must display a notice board in English and the local language stating:
"Determination of s*x of the fetus is illegal and punishable under the law."
6. Inspection & Compliance
Government health officials can inspect ultrasound centers anytime.
Non-compliance can lead to seizure of the ultrasound machine, cancellation of the clinic’s registration, and legal action.
7. Restrictions on Portable Ultrasound Machines
Portable ultrasound machines can only be used in registered medical facilities and not at unregistered places or home visits.
Penalties for Violations
Recent Developments
Authorities are now monitoring ultrasound machines using tracking software to ensure compliance.
AI-based tools are being used to detect illegal s*x determination.
For detailed compliance requirements, clinics should consult their State Health Department or visit the Ministry of Health & Family Welfare website. Let me know if you need more information!
