PRACTICAL GUIDE FOR BUSINESS:
How to Reduce the Impact of COVID-19 in Eastern and Southern Africa:

2.
Provide customers and workers with guidance to encourage hygiene practices and post visible messages on COVID-19 to prevent future infections.

Handwashing and hygiene education remain the most protective actions that can help protect children from a variety of infections, including Coronavirus

▪ There is a high risk of wrong COVID-19 information being shared on social media and elsewhere. Take an active role in disseminating information from trusted sources (see recommended links on last page).

▪ Utilize all internal communication platforms or channels to disseminate validated information about COVID-19. These could include but not limited to: Intranet, email, Website, WhatsApp, Noticeboard, meetings, brownbag and audiovisual mechanisms.

▪ Distribute educational leaflets for workers to support hygiene practices and other protective measures for them and their families. Messaging should follow
WHO advice for the public. Display banners on walls with prevention and protection advice.

▪ For working mothers who are breastfeeding, encourage and support them to continue breastfeeding. Facilities for breastfeeding or milk expression should include the necessary items for adequate hygiene, including disinfecting wipes, trash bin with lid, hand sanitizer with at least 60% alcohol, and access to hand washing facilities.

▪ In case meals are offered at the workplace, practice food safety. This includes advising workers with appropriate precautions for handling raw meat, milk or animal organs to avoid cross-contamination with uncooked foods, as per good food safety practices and
WHO guidelines.

The national and county governments have not expressly introduced "state-backed indemnity schemes" for doctors and others working in general public practice in Kenya. However,a few progressive county governments have already started implementing this important professional indemnity coverage requirement. The Kenya Medical Pharmacists and Dentists Union (KMPDU) representing doctors negotiated a CBA in 2017, and lobbied to have professional indemnity coverage be included as a union member benefit. This indeed was a commendable move by the doctor union leaders.

So what does a "state-backed indemnity" mean for you?

A "state-backed indemnity scheme" usually may provide indemnity against clinical negligence claims arising from public healthcare contracted work. The schemes may not include indemnity for non-contracted public or private practice work, or provide support for complaints, KMPDC inquiries, inquests and disciplinary proceedings among other things.

AfyaCover as product service is here for all your healthcare matters and at Afya we continue to offer advised professional indemnity coverage and support to our subscribers in both public and private practice.

Negligent consent taking? Gain adequate consent to avoid claims

A claim for compensation due to alleged negligence is often made because a patient has unrealistic expectations about the treatment or outcomes. Even though lengthy discussions may have taken place, unless this is clearly documented in the clinical records, that patient may succeed in their claim. Therefore it is recommended to fully document every discussion in the clinical records to validate the patient’s consent. Signed consent forms can be helpful, and sometimes mandatory, but the forms should be specific to the individual treatment planned, rather than an all-encompassing, general consent form.

TIPS TO AVOID A CLAIM
Discuss and fully document in the patient’s record:

• the purpose of the procedure
• the nature of the treatment (what it involves and timescales)
• what the treatment will achieve (taking into account the particular concerns of the individual patient)
• any risks, limitations and possible complications (including rare but significant complications)
• alternative treatments and how they compare
• cost
• post-treatment issues including possible time-off work or the need for future treatment.
