Why need a Declaration Trust when you have Will?

Many people thought is sufficient protection for the family with a Will. However, they have failed to realize a Will cannot be triggered if the person fell under a Stroke, Comatose, or Alzheimer ( or a missing person like MH370), immediately, the family face financial difficulty and couldn’t access any money to treat the person.

Therefore, it is important to set up a Declaration Trust. For example, If the person becomes coma, the Declaration Trust will be triggered and the Trustee will use the power of attorney to access the fund and to settle all urgent expenses like medical cost, nursing support cost etc. At least at this point in time, I don’t want to burden my family members if I unfortunately fall under this type of situation.

Besides that, if you are in business, is good to set up a Declaration Trust to transfer your company shares immediately to your beneficiaries without going to the lengthy and hassle process of Will / Grant of Probate. At least my business will not be affected.

Will Writing is not only for elderly people. It has become a necessity especially family with young children or elderly parents. Just like we buy fire insurance, we continue buying on a yearly basis because we know what if a fire happens, we can recover our losses and restore back our life. Same to Will & Trust, despite we know the chances of using are very slim but what if it happens, at least I can control my wealth is able to channel to my loved ones with my wishes and instructions.

For an elderly parent or with younger children, a family trust fund is important as we can direct the trustee pay for their daily maintenance/living cost, use the fund for their medical cost / medical insurance plan, when children grow older, the money can be used for their education cost. This money will be kept in Trust in a fixed deposit and will be used according to your instruction until children’s eligible age in inheritance to the wealth.
