The Gig Workers Act 2025 [Act 872] has been officially gazetted, marking an important step in strengthening Malaysiaโ€™s labour legal framework for the gig economy.

The Act will only take effect on a future date to be announced by the Ministry of Human Resources Malaysia, and is not yet enforceable.

This is an early signal for businesses and platforms engaging gig workers to begin reviewing contracts, structures and compliance readiness.

The Ministry of Home Affairs Malaysia (KDN) has opened a special application window for employers to submit 2025 foreign worker quota applications from 19 January to 31 March 2026.

This applies to all approved sectors and sub sectors, including the services sector under Ministry of Domestic Trade and Cost of Living (KPDN), which was previously closed.

Key reminders for employers:
โ€ขโ  โ Applications must be submitted directly by employers without agents or third parties
โ€ขโ  โ Submissions will be reviewed in consultation with relevant ministries and are subject to prevailing conditions
โ€ขโ  โ Appointments can be made via KDNโ€™s official system starting 16 January 2026

We are resharing this official notice from Jabatan Tenaga Kerja Semenanjung Malaysia regarding Hari Thaipusam and Hari Wilayah Persekutuan on 1 February 2026.

Key points for employers to note:
โ€ขโ  โ Hari Wilayah Persekutuan is a mandatory public holiday for private sector employers in Kuala Lumpur, Putrajaya and Labuan and cannot be replaced
โ€ขโ  โ As it falls on a Sunday, employers who observe Sunday as the weekly rest day must provide a replacement holiday on Monday
โ€ขโ  โ If Hari Thaipusam is chosen as one of the six selected public holidays, a replacement holiday on Tuesday must be given due to the overlap
โ€ขโ  โ Employees required to work on a public holiday must be paid according to Section 60D(3) of the Employment Act 1955

1. Kerajaan Persekutuan telah mewartakan hari kelepasan am bagi tahun 2026 iaitu Hari Thaipusam dan Hari Wilayah Persekutuan pada 1 Februari 2026.

2. Cuti Hari Wilayah Persekutuan adalah cuti yang wajib diberikan oleh majikan sektor swasta yang berada di Wilayah Persekutuan Kuala Lumpur, Putrajaya dan Labuan kepada pekerja sebagaimana peruntukan seksyen 60D(1)(a)(iii) Akta Kerja 1955 [Akta 265] dan tidak boleh diganti. Memandangkan Cuti Hari Wilayah Persekutuan jatuh pada hari Ahad, maka majikan yang menetapkan hari Ahad sebagai rehat mingguan pekerja hendaklah memberi cuti gantian pada hari bekerja berikutnya (Isnin).

3. Selanjutnya, majikan yang memilih cuti perayaan Hari Thaipusam sebagai baki enam hari kelepasan am yang dipilih sebagaimana subseksyen 60D(1)(a) Akta 265, perlu memberi cuti gantian pada hari bekerja berikutnya (Selasa) memandangkan terdapat pertindihan kedua-dua hari kelepasan am ini. Majikan juga boleh memberikan pekerja mana-mana hari lain sebagai hari kelepasan berbayar sebagai ganti dengan persetujuan pekerja sebagaimana seksyen 60D(1A).

4. Pekerja yang diarah bekerja pada hari kelepasan am layak menerima kadar gaji bagi cuti am seperti yang ditetapkan dalam seksyen 60D(3).
