Performance bonds are a critical safeguard for developers in construction projects, providing a readily available financial remedy in the event of contractor default. In practice, however, calls on performance bonds are often met with urgent injunction applications by contractors seeking to restrain payment.

For developers, the key challenge is not just having the right to call on the bond, but doing so in a manner that withstands legal scrutiny and avoids costly delays.

This session is designed to equip developers and in-house counsel with practical, strategy-driven insights on exercising their rights effectively. We will examine how Malaysian courts approach injunction applications, and how developers can minimise risk while maintaining commercial control. Register here: https://tinyurl.com/yfkhr5u7

Participants will gain practical insights into how businesses can protect themselves against unforeseen disruptions, manage contractual obligations during crises, and ensure their agreements remain robust in an era of heightened uncertainty.

We are pleased to share that our Partner, Naveen Joshua, who leads the firm’s Labour & Employment Practice, has been featured in a recent article on the enforcement of the Gig Workers Act 2025.

With the Act now in force, organisations engaging gig workers are encouraged to review their contractual arrangements, worker classification, and internal processes. As Naveen highlighted, the framework introduces enhanced obligations, including clearer contractual terms, greater transparency in management practices, and stricter compliance with statutory requirements.

Non-compliance may expose organisations to significant legal and financial risks, including liability for statutory contributions, enforcement action, and potential claims arising from misclassification.

Incorporation is often perceived as a shield against personal liability. However, directors may face personal exposure where duties are breached, conflicts of interest arise, or statutory obligations are not strictly complied with.

This webinar examines when the corporate veil will not protect directors, focusing on fiduciary and statutory duties under the Companies Act 2016, shareholder claims, regulatory exposure, and situations where courts may impose personal liability despite separate legal personality. Join us for a clear understanding of how personal liability arises and the practical steps you can take to mitigate risk at the board level. Register here: https://tinyurl.com/mrx6cczc

Our associates, Jason Lim and Tharani Kunasekran, were recently invited to serve as judges for the KYUEM “Litt Up!” Mooting Competition - the first-of-its-kind mooting competition designed specifically for pre-university students.

Jason and Tharani are members of the National Young Lawyers and Pupils Committee (NYLPC), one of the supporting partners of the event. The competition was also judged by sitting judges of the Court of Appeal and the High Court, making it a truly remarkable platform for aspiring young advocates. They witnessed impressive legal reasoning, preparation, and confidence from the participants, and provided constructive feedback to help nurture the next generation of legal minds.

We commend the organisers at Kolej Yayasan UEM for creating a meaningful platform that bridges academic learning and practical advocacy, and we look forward to continuing to support initiatives that empower young aspiring lawyers.
