COURT JAILS MAMA BOKO HARAM, 2 OTHERS DOR N40 MILLION FRAUD

Justice Umaru Fadawu of the Borno State High Court, sitting in Maiduguri, on Monday, February 12, 2024, convicted and sentenced the trio of Aisha Alkali Wakil (a.k.a Mama Boko Haram) Tahiru Saidu Daura and Prince Lawal Soyade to ten years imprisonment.

The defendants were jailed upon being arraigned by the Maiduguri Zonal Command of the Economic and Financial Crimes Commission, EFCC, on Thursday, March 5, 2020 on a two count charge bordering on conspiracy and obtaining by false pretence to the tune of N40,000,000.00 (Forty Million Naira) only.

Count two of the charge reads: “That you Aisha Alkali Wakil, Tahiru Alhaji Saidu Daura and Prince Lawal Shoyade whilst being the Chief Executive Officer, Programme Manager and Country Director respectively of Complete Care and Aid Foundation, (a Non-Governmental Organisation) and Saidu Mukhtar (At large) sometime in Maiduguri, Borno State within the Jurisdiction of this Honourable Court did with intent to defraud obtained the sum of Forty Million Naira (N40,000,000.00) from one Bashir Abubakar, the Chief Executive Officer of Duty Free Shop Ltd under the false pretence of executing a purported contract for the supply of Five (5) X-ray Machines 1900 with Solar Energy which you knew to be false and thereby committed an offence contrary to Section (1) 1(b) of the Advance Fee Fraud and other Fraud Related Offences Act, 2006 and punishable under Section 1(3) of the same Act.”

The defendants pleaded “not guilty” when the charges were read to them.

Counsel for the prosecution counsel, A.I Arogha presented four witnesses and tendered seventeen exhibits before the court.

Consequently, Justice Fadawu convicted and sentenced them to ten years imprisonment for the offence of conspiracy. The court further sentenced the defendants to ten years imprisonment for the offence of obtaining by false pretence and ordered them to jointly and severally pay the sum of N40m to Bashir Muhammad.

“The prison term shall run concurrently on the expiration of all prison terms imposed on the convicts by any court”, the Judge said.

The convicts’ journey to the Correctional Centre began when a petitioner alleged that they swindled him through a purported contract for the supply of five (5) X-ray Machines 1900 with Solar Energy to a Non-Governmental Organization, Complete Care and Aid Foundation, worth N40 Million. They neither supplied the machines nor returned the contract sum to the petitioner.

A JUDICIARY ON ITS KNEES: HUSSEINI BABA-YUSUF, THE CHIEF JUDGE OF THE FCT HIGH COURT NOMINATES DAUGHTER AS 3RD KOGI JUDGE ON THE FCT HIGH COURT ABUJA; GIVES ZERO SLOT TO ABIA, BAYELSA, EBONYI AND IMO STATES

Chief Judge of the Federal Capital Territory High Court, Husseini Baba-Yusuf is on the brink of seating his daughter as one of the newest judges in the system, Peoples Gazette found, meshing contentiously with Chief Justice Kayode Ariwoola and other members of the legal elite who have turned the judiciary into premium job racket for family members.

As with the case of Oluwakemi Victoria Ariwoola, earlier reported by The Gazette, the nomination of Maryam Baba-Yusuf also necessarily involved stunting the career progression of other magistrates from everyday households in at least four states, our findings showed. It was unclear why Mr Baba-Yusuf prioritised his daughter as the third judge from Kogi on the FCT High Court when Abia, Imo, Bayelsa and Ebonyi each has no single judge on the court and the Nigerian federal character policy codified in Chapter Two of the Constitution required staffing the 70-person bench equitably among citizens from the 36 states and the capital Abuja.

Mr Baba-Yusuf has also accepted Munira Ibrahim Tanko, a junior magistrate and daughter of erstwhile Chief Justice Ibrahim Tanko Muhammad, as a candidate from Bauchi, a state that already has Babangida Hasan on the court. Similarly, Kogi already has Eleojo Enenche and the chief judge himself, while Oyo, which Oluwakemi Ariwoola represents, has Mohammed Alhaji Madugu and Ajoke Adepoju. His decision, if allowed to stand, would give Kogi and Oyo three judges each, while Bauchi would have two.

Rather than prioritise ethnic and geopolitical balance, Mr Yusuf-Baba instead appeared bent on foisting a lopsided goal of allocating vacant seats to rookie officers from influential families, even while passing over senior magistrates from states not already represented on the court. His conduct has already set off ructions among judges and clerks, including those who were hitherto gruntled by his leadership of the court, The Gazette learnt.

Documents seen by The Gazette showed Mrs Baba-Yusuf would soon be sent to the judicial council for vetting — and subsequently to the Senate for confirmation — alongside Oluwakemi Ariwoola, who became a magistrate in 2020 and posted to Wuse Zone 2, and Munira Ibrahim Tanko, who has served as a magistrate in Life Camp since 2015. He said he was targeting a deadline of February 19 when he formally informed the National Judicial Council of the nomination process in a January 18, 2024, letter. Of the 12 nominees being considered to fill 12 vacant positions on the court, only those three women have been confirmed to be on a finalised list prepared by Mr Baba-Yusuf’s office. Family or political affiliation of the remaining nine nominees could immediately be reported as The Gazette has not been able to confirm their names on the list. The Gazette learnt states that already have multiple judges, like Rivers (three), Lagos (three), Kwara (two), and Enugu (two) also have at least one nominee each in the latest list.

A spokesman for the court declined comments on Wednesday afternoon, saying Mr Baba-Yusuf would only comment after the process has been finalised. But the chief judge’s action so far has already drawn attention, with a letter from a civic group warning that his action could undermine the Nigerian Constitution.

“The underlying philosophy of the FCC [Federal Character Commission] principle is to provide equality of access in public service representations to curb dominance by one or few sections of the country and also to implement and enforce fairness and equity in distributing public posts and socio-economic goods among Nigeria’s various tiers of government,” Abdullahi Ishiaku, complaints director of International Human Rights Commission in Yobe, said in a letter this week to Mr Ariwoola and copied to Alhaji Bola Tinubu, the Nigerian, the attorney-general’s office among others.
“I was among those who supported the chief judge after his appointment in 2021, and I told him how much I would like to see him succeed,” a judicial officer said under anonymity. “But I am no longer sure where I stand with all these revelations about him.”
The official said Mr Baba-Yusuf’s “puzzling promotion pattern”, if unchecked, would further cost him support in the judiciary. In September, The Gazette reported how Mr Baba-Yusuf was accused of graft by his colleagues on the bench, including financial mismanagement and outright theft of travel and other allowances.
According to the court’s website, at least seven magistrates from the four unrepresented states are currently under the FCT High Court. They are;
1. Chioma Ama Nwachi from Afikpo, Ebonyi State, appointed in December 2020
2. Chituruka Ngozi Abah from Arochuckwu, Abia State, appointed in December 2020
3. Anthony Ngozi Ekwoaba from Ikeduru, Imo State, appointed in December 2020
4. Chiemena Nonye-Okoronkwo from Owerri Municipal, Imo State, appointed in December 2020
5. Elizabeth Jones-Wonni from Sagbama, Bayelsa State, appointed in 2004
6. Abhiranyam Linda Ibegu from Ogbia, Bayelsa State, appointed in March 2015, and
7. Ebiwari E. Damini from Southern Ijaw, Bayelsa State, appointed in March 2015.

The magistrates declined comments about whether or not they would be challenging Mr Baba-Yusuf’s resolve to sideline their states in the last round of judicial appointments.

Who remembers Robert Greene’s theory of unintended consequences often lead to unintended results? This is aptly captured in his celebrated work, The Laws of Human Nature. Some historical illustrations are herein presented:

⚜️In ancient Rome, a group of men loyal to the Republic feared that Julius Caesar was going to make his dictatorship permanent and establish a monarchy. In 44 BC, they decided to assassinate him, thereby restoring the Republic. In the ensuing chaos and power vacuum, Caesar's great nephew Octavius quickly rose to the top, assumed power, and permanently ended the Republic by establishing a de facto monarchy. After Caesar's death, it came out that he had never intended to create a monarchical system. The conspirators brought about precisely what they had tried to stop.

⚜️ In 19th-century India, under British colonial rule, authorities decided there were too many venomous cobras in the streets of Delhi, making life uncomfortable for the British residents and their families. To solve this, they offered a reward for every dead cobra residents would bring in. Soon, enterprising locals began to breed cobras in order to make a living from the bounty. The government caught on to this and canceled the programme. The breeders, resentful of the rulers and angered by their actions, decided to release their cobras back to the streets, thereby multiplying the population from before the government programme.

⚜️ Recall the 18th Amendment establishing prohibitions in the United States in 1920, which was designed to stop the spread of alcoholism but only ended up increasing alcohol consumption by a substantial amount.

⚜️ Another example is the surprise attack on Pearl Harbor by the Japanese in 1941, designed to decimate the US Naval force in one blow and bring America to its knees. Instead, it shook the American public out of its deep isolationism, ensuring the total mobilization of the country's superior manpower and resources to not only defeat the Japanese but also to obliterate its military for good. The very success of the attack guaranteed the opposite of the intended result.

I can go on ad infinitum, but the point I’m trying to make is already at the fore. It’s often said that one need not cut off one’s nose to smite one’s face. The economic policy of Chief Bola Tinubu that led to the ill fated removal of the fuel subsidy and the subsequent floating of the Naira in the forex market has proved to be catastrophic, counterproductive and antithetical to economic development whatsoever, in an underdeveloped or a developing country. LATE ISA FUNTUA’S SON, ABUBAKAR AND HIS UGANDAN ASSOCIATE, ASEGA, ON THE RUN AFTER STEALING N28 BILLION FROM THE NIGERIAN TREASURY

Abubakar Isa Funutua, son of late Ismaila Isa Funtua, and his Ugandan businesses associate, Asega Aliga, have looted N28billion from Keystone Bank and fled Nigeria. While Abubakar is said to have moved to Spain where his estimated net worth is $300 Million in cash and properties, Aliga is said to be hiding in Uganda. The two fugitives also shuttle around the upper scale of the UK.

The duo used 13 dubiously formed rogue companies to collect agricultural loans from the Central Bank of Nigeria, CBN, under Godwin Emefiele as Governor and have since paid only N7 Billion before they decided to go into hiding.

Soon after Isa Funtua’s death from COVID-19 related complications, Emefiele had asked Abubakar to return to site and complete the N30 billion CBN Car Parking Extension contract awarded to Bullet Construction Company Ltd. Abubakar refused. Emefiele also demanded repayment of the long overdue agricultural loans collected by Abubakar. Again, Abubakar refused. The former CBN Governor then debited Keystone Bank where Abubakar and Aliga own majority shares, the sum of N28 Billion being the total loan sum collected.

Insider information at the Economic and Financial Crimes Commission, EFCC confirmed that soon after the investigation of Keystone Bank, it was discovered that Abubakar and Aliga had used fronts to set up another company called Seltrix Nigeria Limited, where most of the N28 Billion collected from the CBN as Agric loans were warehoused. Only about N4 Billion is now left in Seltrix account. Keystone Bank can no longer recover their money because the companies used to obtain those loans only exist on papers.

It is the same model Abubakar and Aliga used in collecting $251 Million loan from AFREXIM Bank to acquire 9mobile, using Teleology/Emerging Market. 9Mobile has now been taken over by AFREXIM Bank after Abubakar and Aliga and their Emerging Market refused pay back the loan.

Burkina Faso, Mali and Niger in a joint press statement issued today, Sunday, January 28, 2024 announced their exit from the Economic Community of West African States (ECOWAS) with immediate effect.

"After 49 years, the valiant peoples of Burkina Faso, Mali, and Niger regretfully and with great disappointment observe that the (ECOWAS) organization has drifted from the ideals of its founding fathers and the spirit of Pan-Africanism," Colonel Amadou Abdramane, Niger junta spokesman, said in the statement.

"The organization notably failed to assist these states in their existential fight against terrorism and insecurity," Abdramane added.
