Here is the constitution that empower the president to declare a state of emergency

Section 305 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), deals with the Proclamation of a State of Emergency.

Here is the content of Section 305:

Section 305: Proclamation of a State of Emergency

1. Power to proclaim a state of emergency: The President may, by Proclamation, make a declaration of a state of emergency if:

(a) The Federation is at war or the Federation is in imminent danger of war;

(b) There is an actual breakdown of public order or public safety in the Federation or in any part thereof to such an extent that the Government of the Federation cannot effectively control the situation;

(c) There is a violation of the Constitution, such as in cases of rebellion or insurrection;

(d) The President believes that national security or the safety of the nation is under immediate threat.

2. Proclamation of emergency: The proclamation must be presented to the National Assembly within two days of the declaration. If the National Assembly is not sitting, the President is required to summon the National Assembly to meet within 14 days to consider the proclamation.

3. Duration and extension of state of emergency:

A state of emergency declared by the President cannot last more than six months, except with the approval of the National Assembly, which can approve an extension of the state of emergency for another six months.

The National Assembly may approve or reject the extension based on the situation.

4. Effect of the declaration: During a state of emergency, the President has the power to take extraordinary measures to restore public order and safety, including the suspension of certain rights or the imposition of restrictions deemed necessary.

In essence, Section 305 grants the President the authority to declare a state of emergency in situations of national crisis, while also providing a framework for the National Assembly’s approval and oversight of such a declaration.

You must understand something, all Southern politicians are driven by untold degree of selfishness. While in office, they are all aspiring for the next office. The strategy to get on the ladder is to sacrifice their people, their towns and villages and their region. They do everything possible to please the Hausa Fulani Northerners in order to be favoured. We can go back a little to pull out some examples.

(1). Governor Peter Odili wanted to run for presidency, he squandered River State money on Northern Emirs and Northern Opinion leaders. At the end, he failed.

(2). General Olusegun Obasanjo held up all development programmes in the South and promoted infrastructure development in the North in order to get the 3rd term agenda through. At the end, he failed.

(3). James Ibori wanted to be a Vice President to President Yar’dua, in place of Jonathan. Delta State Liaison office in Abuja, became an ATM for all the Northern PDP members. At the end, not only did he fail, he was sent to prison.

(4). Jonathan Goodluck postponed South South development to his anticipated second tenure and put in all resources to the rehabilitation of the Almajiris, Emirs Palace from Sokoto to Maiduguri. Built Abuja-Kaduna Rail line when Lagos-Ibadan Expressway was impassable, East-West Road was a mere historical concept; built and completed Federal Universities in Katsina, Jigawa, etc but did foundation ground breaking for the the Federal University in Bayelsa. At the end, he was sent out of the Villa by the Northern INEC Chairman he appointed.

(5). Under Jonathan, the then Minister for Aviation, Stella Odua, funded in full, the rehabilitation and upgrading of the Kano, Sokoto, Katsina Airports but Port Harcourt Airport operated from a Tarpaulin, Enugu completely short down. At the end, AMCON took over all her assets and currently facing EFCC.

(6). Our brother Ibe Kachukwu was the Chairman of NNPC BOT and Petroleum Minister at the same time. He promoted the Ajaokuta-Kaduna-Kano Gas Pipeline. He rehabilitated the Petroleum institute in Kaduna when the Petroleum Institute in Warri was not captured in the budget. He was humiliated out of office.

(7). Obono Obla, SAN was appointed the Chairman of Government Asset Recovery Committee. His target was only all past office holders from the South South and South East. At the end, he was framed and arrested.

(8). The immediate past Managing Director of NDDC and Akwa Ibom State APC Governorship candidate, Nsima Ekere gave out emergency jobs (contracts) only to Southern Contractors fronting for Northerners. NDDC became an ATM for “the Villa Boys”. Where is he now?

(9). Rotimi Amaechi is lobbying to be the next Vice President, in 2023. His first action is to sell the South and became a saboteur. No wonder why as a Transport Minister, he found it very necessary to build the Lagos-Ibadan- Abuja-Kaduna-Kano-Katsina Rail line, Calabar-Maiduguri Rail line, Transport University in Katsina. The Great Eastern Railway line From Port Harcourt via Aba, Onitsha to Enugu to Okene in his books, is not feasible.
The minister is completing the biggest rail and road line into Niger Republic and towards the border of Niger Republic and other countries while the roads in the south are impassable. What Niger Republic has benefited in this Administration is bigger that all that South-South and South-East combined. Who are the Managing Directors of Nigerian Ports Authority and NIMASA?

(10). The current Petroleum Minister, Chief Timipre Sylva, has initiated the construction of the Ajaokuta-Abuja-Kaduna-Kano Gas Pipeline to facilitate the building of a Gas Power Station in Abuja and Kaduna and “to turn Kano into an Industrial Head Quarters”. The man is from Bayelsa State where there is over 90% unemployment and no electricity from National Grid.

(11). Ahmed Tinubu, for his desire to rule Nigeria practically sold the South and with his bullion vans rigged Buhari to power. History will tell of him soon like others.

(12). The number of appointments of people from Niger Republic in Buhari Administration is bigger than all south combined and all the National Assembly members are aware but keep quiet because of future ambition and to avoid probe.

A CELEBRATION OF A VETERAN JOURNALIST @52

The Nigerian union of Journalist has praised one of their own Mr. Awopeju Olatunde for his dedication and integrity as he celebrates his 52nd birthday today.

Awopeju Olatunde clocks 52 on Saturday 27th July. The union joined other well meaning Nigerian in celebrating the fearless veteran journalist.

The union in a congratulatory message said the celebrant loyalty and unwavering commitment to news reporting's and vision has been exemplary, adding that his rising in journalism as a career is not in doubt.

MOGAJI CHIEFTANCY: ODUWOLE ALOWOLESE FAMILY SETTLED FOR BABATUNDE MUSILIU ADEBIYI AS MOGAJI DESIGNATE - By Tunde

Oduwole Alowolese family at inalende area in Ibadan have resolved to close ranks after years of searching for successor.

It would be recalled that, Alhaji Yekeen Olaleye, the first Mogaji died in 2019 after eighteen years reign, and since then, the family had being without Mogaji's.

The situation took a new dimenssion resently when three members in the family expressed their interest over the vacant Mogaji which is long overdue, and of course regarded as a step to Olubadan throne as tradition demand.

After series of meetings among Alowolese family, they all agreed to pick one out of the three candidates viewing the post.

DatelineNews observed that Alowolese family had earlier done their due deligence and screening for the three candidates after which Babatunde Musiliu ADEBIYI, was announced on 28th of April, 2024.

Among those that constituted the Oduwole Alowolese family are: Alhaji Muraina Sanusi, (Olori-Ebi), Alhaji Chief Adeleke Ayoade, (Olori Apena of Oyo State), Pa Olalere Bolarinwa, Pa Abdul Rasaq Oladejo, Bashir Olawoyin Ayoola, Biliaminu Abdul Quadri, Dauda Alade Olasupo, Alhaji Munir Emiola, Abubakri Muraina, and Ibrahim Adekanmi, Ismail Adekakun, Mudashir Olanrewaju, (Secretary to Oduwole Alowolese family) and Abdulrahman Jimoh to mention few.

Some family members in an interview with dateline correspondence said! the coronation process of their Mogaji, will be after the new Olubadan designate, Oba Owolabi Olakulehin is crowned and be giving staff of office accordingly, which is expected in due time.

It would be recall that the Otun Olubadan of Ibadanland, High Chief Rashidi Ladoja, and other kingmakers have differed on the signing of the terms of settlement to facilitate the process of the enthronement of Oba Owolabi Olakulehin as the 43rd Olubadan of Ibadanland.

In a report from the daily news, Ladoja had indicated his willingness to withdraw the suit initiated against other members of the Olubadan-in-Council on the condition that the two parties must sign the terms of settlement as prepared.

The Otun Olubadan made this public at his Bodija residence, while playing host to the visiting Compound Heads of Ibadanland, otherwise known as Mogaji, led by Chief Asimiyu Ariori.

Adding that, the coronation of new Mogaji's will be communicated to the public after Olubadan designate, Oba Owolabi Olakulehin has been crown as the new Olubadan of Ibadanland in accordance with Olubadan-in-council agreed date.

Research by yours truly, (Mr. AWOPEJU Olatunde), Editor-in-chief, dateline Newsonline, and a childhood friend of Mogaji designate, (Mr. Musiliu ADEBIYI), learnt that Alowolese sons and daughters are in diaspora making significant progress, some of whom had extended their heartfelt message of congratulations to Mr. ADEBIYI'S.

Mr. ADEBIYI'S noted that without prejudice, the necessity to recognized some notable members of Alowolese family, the likes of Chief Mrs Modupe Oladejo Akinwande (The Iyalode of Akufo) and a retired Area Manager of WEMA BANK PLC, as well as Alhaji Bamidele Kamorudeen Alade, a retired Deputy Director CBN cannot be over emphasize. Adding that both of who has demonstrated a true becon of hope characterized with human touch.

Biography:
Mr. Babatunde Musiliu Adebiyi had a foreboding at tender age that he was doomed to prediction if he could not endure and square up to the missile of misfortune that faith was viciously hurling at him.

If at such age he did not allow situation at that time to affect his relationship or have any negative impact on his life, then he would not only have a date with history, but definitely cause stir in this generation.

For those that are familiar with his academic and the qualities that emerged with his growing years as a student, his rise in life could not have been a surprise.

His wealth of experience in the oil and gas sector has made him occupy the position of Vice Chairman, IMB of NUPENG, Lagos Zonal Council.

A graduate, with (B.Sc) Hon in economics from a revered Institution, married with kids, family based in Canada and United State of America.

Musiliu Babatunde ADEBIYI, is like every other man with his own bundles of contradiction. But what he has going on for him however are courage, reasons and passion to lead and to serve.
