The Legal Effect of Paying Rent After Quit Notice Does It Cancel the Notice?

This question causes serious confusion between landlords and tenants.

Short answer:
It depends.

When a landlord serves a valid quit notice, the clock starts running. That notice does not automatically disappear just because rent is paid afterward.

Here’s how the law looks at it:

1. Payment alone does NOT cancel a quit notice. If a tenant pays rent after receiving a quit notice, the notice still stands unless the landlord clearly accepts the rent as a renewal of the tenancy.

2. Acceptance matters more than payment. If the landlord accepts rent covering a period beyond the notice (for example, collecting rent for months after the notice expires), the law may treat it as a waiver of the notice.

3. Clear intention is key
If the landlord collects the money but makes it clear it is for arrears only and not renewal, the quit notice remains valid.

4. Conduct can defeat documents
Courts look at behaviour. A landlord who continues to treat the tenant as a lawful tenant may lose the benefit of the quit notice.

Practical lesson:
Tenants should not assume payment saves them.Landlords should not accept rent carelessly after issuing notice.

AS A TENANT, ONCE YOU SEE THIS THING IN YOUR TENANCY AGREEMENT, RUN OOOO 🏃‍♀️

Before you sign and agree to it, make sure you read and understand this p0st

Once you see;

For a Fix period/term of one year, beginning from so so dat to so so dae

Maybe from Jan 1st, 2026 to December 31st, 2026

This is the legal interpretation

Your Landlord is informing you that, your tenancy is a fixed term tenancy and it will last for only one year

So, you should know basically that you have only year to use in that apartment/shop/warehouse and if you wish to stay beyond one year, you must inform your Landlord at least one or two months before your rent expires, to know if your Landlord will agree to let you stay for another one year.

You don't inform your Landlord will mouth oo, you inform your Landlord by going with another one year payment.

If the landlord accepts the payment, your renewal of another one year fixed tenancy is active and the landlord can give you a new tenancy agreement to sign again or the landlord will add this clause below, in the forner tenancy agreement

These are the key points to take note on this Fixed term tenancy agreement you want to sign

If you sign it and agree to it

1. You have agreed basically to waive off your right to Notice to Quit.

Nothing like Notice to Quit for you again, once your rent exoires and the landlord does not want you again

What the Landlord will serve you is, SEVEN DAYS OWNERS INTENTION TO RECOVER PROPERTY

2. You must renew your tenancy before it expires, at least two months or one month before it expires

3. Because you agreed to a fixed term tenancy, your eviction through court process will be very fast because, you have nothing to defend or use against your landlord once your rent expires officially

Court no go delay to come pack your load out if your Landlord file for your eviction in court, if you refuse to leave.

Fear has spread among residents of Lagos following the arrest of two suspected fighters of the Islamic State West Africa Province, ISWAP, in the state, according to PREMIUM TIMES.

It was gathered that the suspects, identified as Modu Gana and Ibrahim Dugge, were arrested on Sunday, December 21, by operatives of the State Security Service, SSS.
