$246k Fine for Whale Watch Kaikōura - A Safety Lesson Close to Home
Maritime New Zealand have prosecuted Whale Watch Kaikōura for two serious incidents involving crew:
- December 2023 - a crew member fell around 2 metres through an open engine room hatch, was knocked unconscious, and suffered head and arm injuries.
- March 2024 - another worker slipped into the sea while refuelling, hit her head, and suffered a concussion.
The company pleaded guilty to two charges under the Health and Safety at Work Act and was fined $246,500.
Each worker also received $5,000 in emotional harm reparation.
Maritime NZ noted that the hazards were long-known, but simple physical safeguards had not been put in place - relying solely on instruction and guidance.
The company has since committed to stronger procedures, training, and equipment/guarding improvements.
Incidents like this are a reminder that businesses must not rely on instruction and ‘training’ alone and must aim for higher quality controls.

Who is actually an officer under HSWA 2015?
Many people think it’s the health and safety manager. Wrong.

One VIP without a vest can undo six months of culture work.
At the City Rail Link test run, the Rail Minister resisted wearing high‑vis on site.
Whatever the reasons, moments like this matter because they set a public example on a live project.
Here’s what I’ve seen firsthand across construction and project environments:
When a senior leader, board member or VIP turns up without the required PPE, it immediately undermines the people who’ve done the hard yards to build a compliant, professional site.
Within days, PPE becomes inconsistent, supervisors spend more time policing basics, and the culture frays. It’s extremely damaging and entirely avoidable.
Leaders: your actions are the standard.
- Wear the PPE the site requires – no exceptions, no shortcuts.
- Do the induction, sign in, follow the rules like everyone else.
- Use the visit to reinforce the team’s good practice, not rewrite it.
Workers notice what you do, not what you say. If you want a high‑performing, low‑risk site, model the behaviours you expect – every visit, every time.
