As per the Omnibus Rules on Wage Determination, the following Establishments may apply for exemption from compliance with the new Wage Order: (𝟭) 𝗿𝗲𝘁𝗮𝗶𝗹 𝗼𝗿 𝘀𝗲𝗿𝘃𝗶𝗰𝗲 𝗲𝘀𝘁𝗮𝗯𝗹𝗶𝘀𝗵𝗺𝗲𝗻𝘁𝘀 𝗿𝗲𝗴𝘂𝗹𝗮𝗿𝗹𝘆 𝗲𝗺𝗽𝗹𝗼𝘆𝗶𝗻𝗴 𝗻𝗼𝘁 𝗺𝗼𝗿𝗲 𝘁𝗵𝗮𝗻 𝟭𝟬 𝘄𝗼𝗿𝗸𝗲𝗿𝘀 𝗮𝗻𝗱 (𝟮) 𝗲𝘀𝘁𝗮𝗯𝗹𝗶𝘀𝗵𝗺𝗲𝗻𝘁𝘀 𝗮𝗱𝘃𝗲𝗿𝘀𝗲𝗹𝘆 𝗮𝗳𝗳𝗲𝗰𝘁𝗲𝗱 𝗯𝘆 𝗻𝗮𝘁𝘂𝗿𝗮𝗹 𝗰𝗮𝗹𝗮𝗺𝗶𝘁𝗶𝗲𝘀 𝗮𝗻𝗱/𝗼𝗿 𝗵𝘂𝗺𝗮𝗻-𝗶𝗻𝗱𝘂𝗰𝗲𝗱 𝗱𝗶𝘀𝗮𝘀𝘁𝗲𝗿𝘀.

Separation Pay is the amount given to an employee who is terminated due to authorized causes such as redundancy, retrenchment, or closure of business. It serves as financial assistance to help the employee during the transition period after losing employment and is exempted from taxation.

However, employees who are terminated for just causes — such as serious misconduct, neglect of duties, or other violations under the Labor Code — are not entitled to separation pay.

When an employee voluntarily resigns, it is generally understood that the decision to end the employment relationship comes from the worker — hence, no separation pay is required by law.

However, there are exceptions! Separation pay may still be granted if it is:
✅ A company practice or policy
✅ Part of a Collective Bargaining Agreement (CBA)
