LTO urges LGUs to suspend their “no contact apprehension” policy

LAND Transportation Office (LTO) chief and Department of Transportation (DOTr) Assistant Secretary Teofilo Guadiz III appealed to local government units (LGUs) that are already implementing the no contact apprehension policy (NCAP) to suspend and consider reviewing such traffic policy.

He encouraged the LGUs to sit down with the LTO to iron out guidelines, including the complaints of operators of public utility vehicles that they are the ones who are forced to pay the fines for traffic violations committed by their drivers.

“Sa ilalim ng batas, ang nagbabayad ng multa ay ang registered owner ng sasakyan, on the presumption na ang rehistradong may-ari ng sasakyan ang nagmamaneho and by command responsibility, ‘yung may-ari ng sasakyan talaga ang dapat na magbayad kung may violation,” Atty. Guadiz said.

“Pero, ito po ay pinag-aaralan namin ngayon. Tila po may kakulangan sa policy na maaaring kailangang repasuhin upang ang mismong drayber o nagmamaneho ng sasakyan ang dapat na managot sa paglabag. We will look into ways na ang dapat managot ay ang drayber,” Atty. Guadiz pointed out.

Guadiz also emphasized that LTO is only helping the LGUs and the MMDA in the implementation by sending alarm about the vehicle in violation while the LGUs draft the guidelines of NCAP.

“Ito po ay proyekto ng mga LGU. Ang part lang ng LTO ay kami ang naglalabas ng alarma sa mga sasakyang may paglabag" the LTO chief added.

Another issue that Guadiz wants to study is if the vehicle is already sold to another individual, and the transfer of ownership is not yet registered with the LTO, and a violation of traffic rules was committed.

"There are instances po na 'yung sasakyan ay nailipat na sa ibang pangalan pero dahil hindi ito nailagda sa LTO, ang sinisingil pa po nila ay 'yung dating may-ari ng sasakyan. We would like to revisit this po," Guadiz assured.

Guadiz believes that the objective of the NCAP is noble, but it should first be fine-tuned for a stronger and more effective implementation in order to contribute to a smoother flow of traffic in Metro Manila.

Section 1. Short Title. - This Act shall be known as the "Motorcycle Helmet Act of 2009".

Section 2. Declaration of Policy. - It is hereby declared the policy of the State to secure and safeguard its citizenry, particularly the operators or drivers of motorcycles and their passengers, from the ruinous and extremely injurious effects of fatal or life threatening accidents and crashes. Towards this end, it shall pursue a more proactive and preventive approach to secure the safety of motorists, their passengers and pedestrians at all times through the mandatory enforcement of the use of standard protective motorcycle helmet.

Section 3. Mandatory Use of Motorcycle Helmets. - All motorcycle riders, including drivers and back riders, shall at all times wear standard protective motorcycle helmets while driving, whether long or short drives, in any type of road and highway.
Standard protective motorcycle helmets are appropriate types of helmets for motorcycle riders that comply with the specifications issued by the Department of Trade and Industry (DTI).
The DTI shall issue guidelines, which should include the specifications regarding standard protective motorcycle helmets.

Section 4. Exemption. - Drivers of tricycles shall be exempted from complying with the mandatory wearing of motorcycle helmets as provided in this Act.

Under Republic Act 10666 or Children’s Safety on Motorcycles Act of 2015, two-wheeled motorcycle riders may not be allowed to drive a motorcycle with a small child on board. The Implementing Rules and Regulations (IRR) stipulate that only children whose feet can reach the foot peg, could wrap their arms around the driver’s waist, and wears protective gear such as a helmet may be allowed to ride on a motorcycle with an adult.

The law covers all public roads, including roads where there is a heavy volume of vehicles, where there is a high-density of fast-moving vehicles, or where the speed limit is more than 60kph. An exception applies only to cases where a child to be transported requires immediate medical attention.

Violators will be fined PHP 3,000 on their first offense, PHP 5,000 on their second offense, and PHP 10,000 on their third offense and suspension of driver’s license for a month. Beyond the third offense, violators will have their licenses revoked.

The Department of Transportation believes that this proactive and preventive approach will secure the safety of passengers, especially children. The Land Transportation Office (LTO) shall be the lead implementing agency and may deputize traffic enforcers and Local Government Units (LGUs) to implement the law.

RA 10666 was signed on July 21, 2015 but was only implemented now upon the aggressive push of Secretary Art Tugade.






According to the World Health Organization, in its 2015 Global Status Report on Road Safety, 53% of reported road fatalities in the Philippines involved motorcycle riders.

Sumunod dito ang (2) unattended illegally-parked vehicle, (3) dress code for riders, (4) stalled vehicles, (5) no/defective traffic lights, (6) reckless driving, (7) obstruction, (8) attended illegally-parked vehicle, (9) truck ban, at (10) illegal turning.

Sa panahon ngayon na muling dumarami ang mga sasakyan sa lansangan, napakahalaga ng disiplina at pagsunod ng mga motorista sa mga alintuntunin na ipinapatupad sa lansangan.

Sumunod sa batas trapiko hindi lamang para sa kaligtasan kundi para sa kaayusan.
