May brought relevant legal updates in Portugal, including the amendment of the General Waste Management Regime (Decree-Law no. 81/2025), completing the transposition of Directive (EU) 2018/851, and the definition of VAT payers subject to automatic periodic declarations (Ordinance no. 242/2025/1).

Noteworthy as well are updates on family protection and domestic violence risk assessment tools, as well as a Supreme Court ruling reaffirming that holiday and Christmas allowances are mandatory in Portugal, even under foreign employment contracts. The Council of Ministers also approved transitional renewable energy targets for industry and transport through 2030.

Key Legislative Updates – January 2025
January saw significant legislative developments, including the Law No. 1/2025, which implements European regulations on financial services and infrastructures in Portugal. This law also amends Decree-Law No. 80-A/2022, introducing measures to mitigate the impact of rising reference indexes on mortgage credit contracts.

Other notable updates:
Ordinance No. 6-A/2025/1 – Updates occupational accident pensions for 2025.
Ordinance No. 6-B/2025/1 – Adjusts the social support index (IAS).
Ordinance No. 19/2025/1 – Sets the 2025 average construction value.
Decree-Law No. 2/2025 – Implements Regulation (EU) 2022/868 on European data governance.

In case law, the Constitutional Court’s Judgment No. 18/2025 upheld the constitutionality of replacing an absent legal representative at trial without the defendant’s consent.
