Many immigrant families — especially those with elderly loved ones — often ask us:

"If we use public benefits, will it affect our green card application?"

Actually, most of what people have heard about the "Public Charge" policy is based on outdated information.

Starting in 2019, there was indeed a period when the standards became much stricter.
Even programs like Medi-Cal (Medicaid in California), CalFresh (food stamps), housing assistance, and even school lunch programs for children were considered negative factors under the rule.

During that time, many people who were eligible for benefits didn’t use them — out of fear that it might affect their immigration status.

But that policy was officially repealed in 2021, and the rules returned to the more flexible, pre-2019 standard.

So what actually affects your green card application now? Just two things:

1️⃣ Cash assistance, such as SSI (Supplemental Security Income) and TANF (Temporary Assistance for Needy Families)
2️⃣ Long-term institutional care fully paid for by the government — like extended stays in nursing homes or ICUs where the entire cost is publicly funded

✅ On the other hand, programs like Medi-Cal, CalFresh, WIC, housing subsidies, and vaccines are considered safe to use and do not count against your green card application.

許多移民家庭，尤其是家中有年長親人的家庭，常常會問我們一個問題：

「使用政府福利，會不會拿不到綠卡？」

其實，大家聽到的「公共負擔」（Public Charge）政策，很多都是過時的資訊。

從 2019 年開始，公共負擔的標準曾經變得非常嚴格，
當時連 Medi-Cal（白卡）、CalFresh 糧食券、住房補助，甚至學童的免費營養午餐 都可能被視為負面因素。

那段期間，很多明明有資格使用福利的人，因為擔心影響身份，選擇放棄申請。

但這項政策在 2021 年已經正式取消，標準也回到了 2019 年以前較寬鬆的版本。

那現在，什麼才真的會影響綠卡申請呢？其實只有兩種情況：

1️⃣ 現金補助，例如 SSI（聯邦補充保障收入）、TANF（低收入家庭臨時救助金）
2️⃣ 政府全額負擔的長期機構照護，像是長期住在療養院或加護病房，且所有費用都由政府支付

✅ 至於像 Medi-Cal（白卡）、CalFresh、WIC、住房補貼、疫苗等日常福利，都不會被列為公共負擔，使用起來是安全無虞的！
