PBM Enforcement Update

The TN Dept. of Commerce & Insurance (TDCI) just took action against two major PBMs:

* Express Scripts (ESI) fined $250K for 12 violations, including underpaying pharmacies, favoring affiliates, and illegal recoupments.
* Caremark fined $750K (3 separate $250K fines) for failing to report key info on MAC lists, networks, appeals, claims & audits—even after extensions.

At the time, $250K was the maximum fine allowed. But starting May 2025, that cap is gone, thanks to TPA-backed legislation (HB 1244).

Future violations could come with much steeper penalties.

We knew it was coming, but we also know this wasn't a mistake. Express Scripts knew exactly what they were doing and if even one person transferred, they were successful. We have filed a complaint with the Alabama Department of Insurance and I would recommend anyone who'd like to do the same. These billion dollar companies constantly steer patients away from independent pharmacies and get away with an "oops, our bad" letter. Enough is enough!
