If this bill becomes law, patients without their card in hand—or those waiting for a renewed card—could be charged under South Dakota’s outdated drug laws. Affirmative defense is not a get out jail free card, it simply protects legitimate patients from becoming criminals due to delays or hardship. 70% of South Dakotans voted to allow medical cannabis. Patients who follow the rules should not face felony charges because of bureaucratic obstacles.

Great news from Pierre! SB 181 and SB 194 have been deferred to the 41st day - essentially killing the two bills.

Senate Bill 181 would have repealed the medical cannabis program in its entirety.

Senate Bill 194 aimed to implement arbitrary potency caps on medical cannabis.

Thank you to everyone who contacted the committee members! We would especially like to thank Tyler Koehne, Alan Welsh, Kenny Sharp, and Liz Tiger for making the trek to Pierre to give passionate and moving testimonies in opposition to SB 194.

Medical cannabis is under attack TOMORROW.

SB 194 would limit how strong medical cannabis can be, putting politicians between patients and the medicine that actually works for them.

The vote happens Wednesday (TOMORROW) morning (2/11).
